Living in UK, married in UK with Canadian citizen

Hi,

I am Italian, living in London and married with a Canadian citizen who currently lives in Montreal. We got married in London in September 2015.
I have some questions about the Visa process:

- Can I go there on holiday and apply for the spouse sponsorship from there?
- If possible, would they need to keep the original copy of my passport? For how long?
- Can I apply for the working holiday Visa to move there quickly and apply for the spouse sponsorship from there?
- Again, if possible would they keep my original copy of my passport, and for how long?
- Is there any working limit on a working holiday visa? I.e. maximum number of hours per week?
- Should I apply for the spouse sponsorship from London UK, would they need to keep the original copy of my passport and for how long?
- How long does it last the spouse sponsorship?
- Can I keep working for my UK employer while in Canada on the WH visa?

- Yes, you can go there on holiday and apply. Note you'll need to obtain an ETA to come to Canada.
- Your passport isn't needed.
- You don't qualify for an IEC since you are living outside of Italy. You would need to be living in Italy to qualify.

- Depends how you apply. If you apply outland, less than 8 months. If you apply inland, around 2 years.

does the IEC qualification not depend technically on whether the OP is an actual perm resident in UK as opposed to just living in UK. If OPs perm residence is still Italy then even if living in UK they could qualify for IEC at least thats the result shown by the come to Canada wizard. If the OP is a UK perm resident then agree do not qualify.

You need to be living in Italy to qualify for the IEC. Stating you're living at your parents' address when you're actually living in another country will most likely be classified as misrepresentation and could land you a 5 year ban. See the residency requirements column in the link below. Most countries do not require residency. Italy is one of the few that does.

Spousal sponsorship application costs $1040 in fees. You will also have to pay for the medical and police certificates.

OP would need to be a UK citizen to participate in the program as a UK participant. Per link above, Italy is one of the few countries that actually requires residency in the country to qualify.

This shocks me as I didn't expect I could not apply for the IEC!

Given my conditions, what is the best way for me to move to Canada?

- Apply for the spouse sponsorship from UK, which means waiting for 8 months? What happens if I change address during this period, i.e. move within UK or move back to Italy?

- Go to Canada on holiday and apply for the spouse sponsorship from there? Does it mean I cannot work for 2 years?

If you come to Canada and apply inland, you would include an open work permit with the application which will be granted approximately four months after the application is submitted.
