Hi everyone,

I am a Canadian citizen with a US green card. I married my husband (american) and we have 2 children together (born after the marriage)

We have recently been discussing moving back to Canada. My husband and children would live in Canada with me but he would remain employed in the US and cross the border daily. His current job would be close enough to where we live in Canada that he could maintain his current employment And just commute daily.

My question is, because I currently do not work would I have to provide financial proof to sponsor him and our children? Would he be allowed to work I. The U.S while living in Canada?

Also because my girls were born in the US but I was only a US green card holder and still a Canadian citizen, do I have to sponser my children too or do they automatically become Canadian citizens?

I'm assuming you're asking about your husband working in the US while his application is processing, and not after he becomes a PR. Until your husband becomes a PR, he cannot live in Canada, he can only visit. You may run into some trouble with him crossing back and forth every single day, as they will start to catch on that he is sleeping in Canada every night and thus "living" there. Some Americans do this with no issues, others get in trouble and eventually get denied entry. It's something to think carefully about and analyze the risks and have a plan in place as to what you would do if he were ever to be denied entry.

Once he is a PR, he can cross back and forth every day with no issues, as he has a legal right to enter, live, and work in either country.

You would need to provide proof of how you guys plan to support yourselves, yes, which can include any savings you might have.

As long as you were born in Canada or are a naturalized Canadian citizen, your children are also Canadian citizens and do not need to be sponsored. The only case in which they would not be Canadian citizens would be if you were born abroad and claimed citizenship from your parent(s).

Your children won't need to be sponsored but there will be paperwork to get their citizenship. I had the opposite where my son was born in CANADA and I had to apply for his US Birth Abroad and now he is a dual citizen.

Get a certificate for someone born outside Canada
Some people born outside Canada to a Canadian parent became citizens at birth. For more information on the rules around citizenship by descent, see our changes to citizenship rules.

If you are not sure if you or your minor child are citizens, you can check by:

  • applying for a citizenship certificate
If you apply for and receive Canadian citizenship (naturalization), you will receive a citizenship certificate at your citizenship ceremony. You do not need to apply for one.

If you aren't working then you will need to provide a letter stating how you plan on supporting your husband. Explain that he is going to commute back and forth and continue to work in the United States. My husband is planning on doing the same thing. It would also be beneficial to him to get a NEXUS.

I should also add that I am a Canadian living in Canada, I am working full time. My husband WAS here for a year but his Visitor Extension was denied so now he is in Buffalo Monday-Friday and comes home on the weekends until his PR is approved.
