Lived on refugee status in another country

Dear Friends,


I went to Australia on student visa in 1997 in a private college. After I completed 2 years of study, someone told me that the diploma from the college I obtained will not be taken into consideration to apply for work permit (I was not prepared to apply for PR for Australia). So, in order to stay for a couple of more years and come back to India after earning good money to start my own business, I sought advice of an immigration lawyer who misguided me to apply for refugee and I did as the lawyer said, of course I worked illegally. After a year or so, on a tip off, the immigration department officials raided my house and after knowing my status and breach of work rules, they asked me to either withdraw my refugee application and fly back to India or remain in the detention centre till my refugee application is decided finally. I, then opted to withdraw the refugee application and arrived back to India in Dec. 2000.

Now, I want to apply for Canada immigration as I qualify under federal skill category. Will my refugee status in Australia affect my proceedings for PR application for Canada? Kindly answer with the facts so that I know where I stand?

Refuge application will not matter as much as your illegal stay will. No one on this forum will be able to provide you true legal advice. It will be best if you contact a immigration lawyer as they might have had experience with such cases.

Well, my stay was not illegal but I worked illegally. If I had not been found working illegally when the immigration officials raided my apartment, they would have never asked me to leave Australia or remain in detention centre till the decision.

I am sorry I did not mean to offend you by saying illegal. Your case is unique and there should be someone else who can answer on this forum. My opionion it will be best to contact lawyer to avoid rejection. Once rejected you will have to always declare that you were rejected if you apply again.
