Live-in Caregiver to Visitor

Hello there! Hoping I'll be able to get help from here. I came to Canada in 2016 under the Live-in Caregiver Program but lost my job when I had to go back to the Philippines for emergency reasons for an extended period of time in 2017. I was able to find another employer but after a year of waiting and trying to fix their issues, turns out they couldn't obtain a LMIA. Got married here last January and we are still on the process of completing requirements for Spousal Sponsorship. What I'm worried about is that my TRV is expiring in May. We are looking at the option of me applying for a change of status to a Visitor. Is that possible? TIA!

Oh my God. I am so sorry my dear for what happened. A similar stituation happened to me: an emergency happened and i was terminated. Its so sad.

But my dear i am glad you have your husband. It is possible to get a TRV in the meantime but you should see if there are any other options there for you by seeking legal advice. Dont wait too late to start doing your checks

What is your husband’s status in Canada? Have you applied for spousal sponsorship? Inland or Outland? Yes you should likely be looking at changing your status to a visitor if you haven’t filed yet or until your PR has been accepted without any errors. Would warn you that given your circumstances and the fact that you seem to have gotten married rather quickly if you were gone for a large part of 2017 there will be concerns about marriage of convenience so that may cause some delays.

My Husband is a citizen
we haven't submitted the application yet as I am still waiting for a certain document.
We're planning on Inland. I was gone for a month in Feb 2017 and had a new employer start a LMIA application for me, signed a contract in August but I only learned recently they aren't able to get approved so it really put me in a delicate situation here. as for getting married quickly, our relationship started Sep 2016 and we've been living together since losing my job. We will be able to provide proof of relationship before getting married in January, we're hoping it will help
would it be better if I apply to change status right now or wait till our sponsorship application is submitted before I change status?

You need to apply to change your status 30 days before your work visa ends. I thought you meant most of the year when you said extended amount of time in 2017. Given the end of your visa there will always be some suspicion but as long as you have proof of your relationship you should be fine.

Your TRV expiry is irrelevant. When did you return to Canada? Did you enter on your work permit from your previous employer or as a visitor?

Sorry that was my fault. Trv is a travel document to get into the country. Work visa is what is important. You must switch to visitor status 30 days before you work visa expires.

On my work permit from previous employer
A TRV is simply permission to board a commercial carrier to travel to Canada. It has nothing to do with your status in Canada.

You should apply to change your status to visitor a few weeks before your work permit expires.

I am currently filling in the form IMM 5708 and I'm not sure on what's the right box to tick on the following choices considering my situation:
*extension of my temporary resident status
*initial temporary resident permit or extension of temporary resident permit
*restoration of temporary resident status as a visitor
