Hi all,

I just had a query regarding the PR application. I am living in Canada and I am planning to apply for PR in CEC class. I am married and I have opened my divorce case with a law firm right now. Since me and my husband have not been separated for a year, the divorce application is not exactly filed in the court yet. But now, I wanted to know if I should select ‘Married’ or ‘Divorced/Separated’ or ‘legally separated’ in my application.

Some consultants say that I am not actually separated for a year and not divorced so I should put ‘Married’ and say that my spouse is not accompanying me to Canada to not include him in the application. Another consultant said that I since Me and my husband have decided to separate and have opened a case file, I should put ‘Divorced/Separated’.

You are not divorced so you cannot select divorced. You can select separated if you have proof of a separation or write a letter of explanation.

You are legally separated. Include proof of your dealings with your lawyer about the divorce.
