Hi there,

I was going to extend my Visitors Visa while my permanent residency application goes through, and didn't think it would take very long but I only have till the 2nd of February, and was only putting it in now.

It indicated the reciept would take 2 weeks, and the application 30 day's. Oops.

If I went to the US, then came back to the States(Just cross the border) , would that give me another 6 months since I'm re-entering Canada?

Is there any other option to extend my stay now since I've messed up?

We have not yet submitted the application for residency.

Thanks

So if you've already submitted your PR, then I would advise AGAINST leaving the country as they could always deny you re-entry into Canada and that's up to the discretion of the border guard you happen to encounter. In my opinion, I would file it and mention somewhere the reason for the delayed application for extension. In my experience, CIC is happy if they receive money and if you haven't done anything illegal or sketchy. So my opinion would to be to submit it. Once they send receipt of getting it, you have implied status til they give you a decision so you would be set there.

I am currently on implied status even though I filed a month before the expiry of my visa. The wait time is something like 3 months so just sitting in implied status gains me some time as well :)

Hope this helps!

We haven't filed for the Residency yet.

I was going to file an outland application, but that does not include implied status does it?

Do you think if I applied for outland status, and added in the application for extention of visa, even if I don't get receipt of it before I'm supposed to leave, it would be okay?

Or should I now apply via an inland application as this will give me applied status as soon as they receive it?

I can't even send in my application for extention as I need to wait up to 2 weeks just for the receipt document to pay the fee's.

Lol, my partner and I are both procrastinators. Oops.

Oh if you're filing outland then you can leave the country, if inland, then you are advised not to.

You can file the extension online and pay online, thus not requiring the 2 week wait for the receipt as it's instantaneous.

How far are you in the process of applying for PR? If you go outland, it's quicker but you can't work in Canada. If you go inland, it takes longer, but you can start working after 6 months if you file for an Open Work Permit (OWP) with the PR application.

Since your visitor stay is still valid, you can file an extension. You will be on implied status until you hear back on the extension decision. Make sure you keep a copy of your application and proof you mailed it (consider mailing it with signature required at receipt) as it is the proof of your implied status. Many people have reported submitted copy of payment for their PR application if they don't have an AOR yet to show that they are serious (can you pay it online with a credit card?). If you have it, also mail in a copy of the delivery receipt for your outland PR application.

http://www.cic.gc.ca/english/visit/extend/visa.asp has links to both the online and paper applications.

I tried that one, and when you work through the questionaire, it ends with "you can extend your stay once in Canada" and that's it. I think you can only pay for immigration applications online, not visitor extentions but perhaps there's something I'm missing.

I guess I'll keep searching the website. I just got so frustrated today.

go here to pay online https://eservicesak.cic.gc.ca/epay/welcome.do?lang=en click on temporary resident and then click on Extension of Authorization to remain in Canada as Temporary Resident (extension of visitor status) Done!! Dont forget to tell them you are in the process of applying for permanent residence family class and show evidence of how you are able to support your self during your stay.

You want to apply for the visitors extension through http://www.cic.gc.ca/english/my_application/apply_online.asp?s=1 (or click on apply online from the main menu off of cic.gc.ca and then 'extend your stay as a visitor'. If the online option doesn't work, send in the extension through regular mail. It will give you a few more days too while your application is 'on the way.'
