hello all,

If you are reading this, thank you for taking the time. If you reply to the thread, even more thanks for helping me out! Here’s my question/story:

I am a Canadian citizen who married a South Korean man last year in August, and applied for inland spousal sponsorship in Nov 2018. We did hire a lawyer in Canada to help us, but me being the worrisome/paranoid person I am, I’m still feeling uneasy because of our situation and would like more input. Anything that would ease my mind.

So, we currently live together in Canada and we have booked a flight to South Korea for two weeks in April so we can visit and see my husbands family and we will also be having our Korean wedding there (we are already married but having another ceremony). My mother in law has already planned it out and booked the venue so I really don’t want to post-pone it :|

Anyway, we sent the application in Nov 2018, received notice they got our application in early Feb (and then to get a medical exam) and now we are waiting for the OWP.

We plan to fly mid-April, and I’m like freaking out that the OWP won’t come in time :( it’s already mid March now...
I asked my lawyer what to do, and she told me that she will provide an official letter written by her and that we can use an eTA if we don’t get the OWP.

Now, I’m wondering is this enough? I’m thinking to bring with me the receipt of the CIC fee, a copy of the email we got from CIC stating they got our application and other proof we live together.

My other question is, if we don’t get the OWP in time and the border officer asks if he’s going to stay in Canada to visit or for work, what do I say? I don’t want him to get in trouble...will they issue him visitor entry only and then he can’t work after coming back?? Or will the lawyers letter /documents be enough?

Thanks guys!!

It isnt recimmended you leave duringthe process but a short exit is ok. The issue is if they dont allow him back into canada your application is cancelled. Having an owp is not a guarenteed re-entry to canada

i left canada for two months already and will be back maybe next month and i have TRV and Post-graduate work permit .. i wont have any problem to re-entry ... so he doesnt need VISA to entry canada since he is korean and if the officer asks whats his purpose of visit just tell them you guys had wedding back home... two weeks wont make any problems.......

God forbid he gets denied and the application gets cancelled...but let’s say there was a chance it does...would I have to reapply as Outland and do I have to pay the full price again?? How long would it take? I’m tearing at the thought of being separated from my husband :,(

So if the officer asks why he’s coming to Toronto, do I tell the officer we applied for PR and we just went to Korea for our wedding, or should we say he’s just visiting and will be staying with me? >.<
Sorry, I’m just confused as I haven’t travelled out of the country by plane in more than a decade and I’m afraid of border officers lol

CBSA will be able to see the PR app in the system, so pretending he is a normal visitor is a bad idea.

Ah, so all in all telling the absolute truth is the best way to go?
Can you tell me how I should say it to them? “Officer, my husband and I just had a wedding in Korea and we stayed there for two weeks. We had applied for PR last November and he’s on the waiting list. *shows proof*”. Is that enough explanation?

I’m praying I get a friendly/decent CBSA officer.

Also thank you everyone for replying :)!
