I am a US citizen commuting to work in Canada (working in the Oil Sands). I have a Work Permit that expires in September 2015. However, I was told by my immigration lawyer that my current LMO (from my company) expires April 2015. As the conditions in my industry make getting another LMO difficult, it was suggested that I go ahead and apply for an extension 6 months early (for a work permit to expire in April 2016).

My question is: Can I leave the country to go back to the US without jeopardizing my application for work permit extension? I know that if I have implied status AFTER the expiration of my current work permit and I leave the country, I may forfeit the extension application. However, what if I still have 5 months on my current work permit, how will it affect my application?

I have no desire to stay in Canada for the next 3 months waiting for a response to my application as I have a family (wife and children) in the States, but I do not want to risk my permit extension.

My immigration lawyer tells me that I should stay in Canada. Does anyone have in info on how this works?
