Wondering if anyone knows for a fact if spousal sponsorship & PR is considered abandoned if applicant leaves Canada. I sent spousal sponsorhip app in Nov 2009 for my husband and we learned that our file has now been transferred to local office in Vancouver : (

We have baby due in December 2010 and we can wait another year (or however long Vancouver office timeines are) without my husband working - we decided husband needs to go back to US to work while I take maternity leave. We are afraid his file will be thrown out if he leaves Canada... also does it matter if he come/goes via land border or via air??

They wont just throw it out its that you leave the chance he wont get back in for any reason once that happens it will be refused based on the fact you could not get back in and it states you must be inside Canada to do an inland.
So if for some reason he cant get back in it might just go the whole way and they may never know,but thats the chance you take i guess.

well i am in the same situation my inland appication is in process and i left Canada, now my TRV has expired and i am too scared to apply for a TRV because they might find out and refuse me the visa and also deny my application. I am praying that everything is smooth and they dont call me for an interview, and say if they request for my passport than i can post my passport to my wife and she could post it to the immigration office. But i dont know whats going to happen i hate this stress, this whole process has put me off Canada big time..

crazylove: the PR is issued for inland applicant when they call you for an interview. They're gonna ask you to bring IDs etc and then you're granted PR/landed. There is no passport request like the outland app where others mail them. Its different for inland. So you have to be in Canada.

No, apply for a TRV to get back in to Canada. If it is refused, then cancel your inland PR application and start a new one - this time outland.

Yep.. I agree with canadian woman. dont give up as yet!. Apply for a TRV first. If denied then apply outland..

As others have already said....Inland there is no passport request....you have to attend with your sponsor and any dependents being sponsored at the designated visa office.

Apply for the visa and see what happens.

Here is my dilemma,

I have lived in Canada since 6th oct 2009, during that time i have visited UK from 1 april - 1 june. then i came back to Toronto on 1st june and left canada again on 4th aug.

Now my TRV has expired and my inland appication is in process. Now the problem is i am in UK on a Work visa and its expiring on 26th sept 2010. I am thinking of applying for a TRV at London Embassy, but i am not sure what to say in my TRV application.

Should i say i am going to Visit my GF? (offcourse she is my wife now) for a week and after that i am going back to my home country Pakistan. But WHat if they ask me what i have been doing all this time? and they could tell i was in Canada?

or should i be honest with them and say my inland application is in process and if my inland application is denied i will leave Canada and my wife will come with me and i will apply outland..

Please advise how do i convince the VO. Plus i dont even have consistent UK bank statment to back myself up.

I gutted, please help

Hey guys,

Well my wife is really pushing me to apply for TRV next week but i am not very convinced because my work permit in UK expires on 26th sept.

Anyway she has sent me the invitation letter stating that she is inviting her partner (me) to visit her for 2 weeks from 25th sept - 9th oct, she said i am moving to Dubai to commence work from 1st nov 2010 and she would like to see me before i move further away from Canada. And she is paying for this trip.

I will include the job offer email i got from a bank in Dubai too.

Point to note is that i have already been issued canadian TRV in the past twice. 1st one was a single and second time they gave me Multiple entry. Do you think this makes my chances good? and also my wife works for the canadian government.

I personally think i should not apply for a visa right now, and move to dubai start work there, and once our inland application 1st stage is approved (sponsorship approved) then i should apply for TRV from Dubai and be honest with the immigration officer and tell them i left Canada in an emergency while my inland application was in process and while i was outside Canada my TRV expired, now that our sponsorship is approved I need to be in the country to pursue my application therefore i need a TRV to enter Canada. I think it will give me some sort of leverage.

Anyway i under a lot of stress, i am want to work too thats why i am attracted to move to Dubai and then i want to be with my wife and pursue my application too.

What do you guys think what route i should take. I thank you all in advance for your input

i will be including the job offer email to satisfy the IO that i would be leaving Canada after two weeks to start my new job. Is it good enough for satisfying the IO. Obviously my work permit in UK is expiring so i wont be having any ties here. So dubai job offer is my solid reason to leave.

If you're not going to be staying in Canada and working in Dubai for the time being personally I would withdraw the inland application and apply outland right away. It seems it will be too much of a hassle to get your TRV, which I can't see them saying yes too. If she writes you an invitation letter like she is just inviting to you to visit without revealing an application is in process...just doesn't seem right. What if they cross reference and see your application in the system?

How long has your application been in process?

Well if they issue me a TRV then off course i am planning to stay in Canada, they received my application on 23rd feb 2010 and started processing on 10th may, according to the website they processing application received in early to mid december. I am two more months away from my application being processed.

Crazylove, I would apply for the TRV right away. They are not more likely to give you one because you have an inland PR application in process.
Apply for it now, and you will then know what to do. If they give you a TRV, go to Canada and wait for the inland application to go through the process; if they reject your TRV app., your inland applicaiton is dead. So then you should reapply outland.
It is better to find out now if you need to resubmit an outland application.
