Hey guys, pls we need urgent advice on what to do, our 1st outland spousal app was refused, so we hired a lawyer for an inland reapplication, all this was in February, he kept delaying to submit our application until august jst to keep taking money from us, we have paid him everything and was already arguing about it until he decided to submit our app in August, but b4 the submission he kept threatening us that he will withdraw from representing us if we dont come up with money, we paid him $5000 which we agreed on, then after he submitted, he said we have to pay him another $5000 and if we dont pay it, he will withdraw from representing us, so pls we need an advice on what to do BC the correspondence is on his email and office address, and we have honestly done everything he requested.. The extortion is too much on us... Pls we need help and advice, thank you

Remove him as the representative first (make sure he has submitted your app and have the relevant information), then send him a little note explaining he's fired. You'll probably get significantly better and cheaper advice here than you would from you current council.

Honestly, if I were you, I rather worry about another refusal of the in-land application. I checked back your posts, and based on your own words, I believe your wife is currently out of status in Canada, right? You were thinking appeal the first refusal, then probably found out the whole process could take some two years, then you switched to decide to reapply in-land. Well, I guess at least you can apply OWP for your wife with in-land application, right?

Don't give me wrong, I am not judging you. It is fine for me that you do whatever necessary that will be good for your family. The only point I want to make here is Have you ordered the Blue Book to figure out the reason(s) that your first application was denied? If not, then I believe there will be a big chance that your in-land application will be denied as well. Worse yet, once in-land application is denied, you will not have the right to appeal. And I know you think the first denial was because the additional proves you send to CIC was one day late than 30 days they required. But actually, you sent them out before the 30 days limit, it shouldn't be the reason.

The only way that a reapply would work is that there are significant change(s) in your way of life. If you just submit the same or slightly more proves that you submitted in your first application, then it won't work.
 
You cannot appeal an inland application. Sorry I thought the first was inland. But I see now it was outland.

submit new representative forms on their it asks you to provide your new rep. to also get the lawyers counsel # call CIC call center and ask them to ensure your new application has been submitted if yea ask them for the lawyer representing you # and most likely they can provide it to you to report him for extortion to the link provided to you above
