Landing with/out dependants and PR status maintenance ?

Dear All

Please help with following questions, especially Qorax . .

I have applied with spouse and one 2 year old child and going to send Right of Permanent residence fee

1. The total would be 490 + 490 + 150 USD ?

2. Suppose I the principal applicant land there alone -- and dependents dont travel at all on PR visa ? Does this mean only I will get PR card and they will not get it at all ? And in that case should i only send RPRF fees for only myself ?

3. Suppose all 3 land there and get PR cards -- but later only I or spouse is able to maintain the PR residency status requirements . . . Does that mean only that person will stay resident and later become citizen and others will lose their PR status ?

4. Suppose only 1 of the 3 is able to get citzenship ? Does this mean he then has to sponsor wife and child ? how long does this take ? and do the dependants have to be living in canada for this to take place ?

5. Suppose after getting our PR cards, spouse has baby in canada -- will baby be Canadian Citizen ?
In that case if the entire family does not reside in canada for the required 2 out of 5 years -- will the parents be able to keep their PR status, since they are parents of Canadian citizen living outside canada ?

6. If child is canadian citizen does he have to be 18 before he can sponsor parents ?

Is it your intention that only you will land? Then you can advise the visa office that you want to change your wife and child to not accompanying and only pay the RPRF fee for yourself. Your wife and child will not get a visa then and will not get PR. Otherwise, you pay and they will get the visa and have the chance to land, even if they possible don't.

If one of you doesn't meet the residency requirements, then that one will lose the PR eventually. Your PR is not tied to that of your wife. Each of you had to meet the requirements on an individual basis. If one of you stays in Canada for 3 years and applies for citizenship, passes the test and attends the oath, then that one will become a citizen.

You don't have to sponsor your wife and child if they already became PR unless they did not stay in Canada and lost their PR. The processing time depends on your home country and could be a few months up to 2 years. You also don't have to have citizenship to sponsor. A PR can sponsor but he must be living in Canada himself in order to do that. The dependents do not need to be living in Canada.

Yes, the baby will be a citizen

No, you can not use a baby to preserve your PR. A PR is only preserved if you are living with a Canadian citizen spouse or if you are a child living with a citizen parent.

6. If child is canadian citizen does he have to be 18 before he can sponsor parents ?

Yes, he has to be at least 18 and he has to be making enough money to support his parents as well as his own family if he has one. The program for sponsoring parents is currently being revised and in the meantime, they are not taking any new applications. The wait in that program is several years.

Dear All,

Am a PR holder from 2011. Can any one advise on how to get Visitor Visa in US for 2 weeks. Am currently in Dubai working in a MNC company. They are willing to send Michigen for 2 weeks training. I have very short period and the training will start in 3rd of 4th week of this month. Please guide me. Thanks.

You are in the wrong forum, look for forums on US immigration topics. However, you are still subject to the same procedures, your PR status will give you no privilege when applying for US visa unless you apply at a US visa office in Canada, then you may receive some privileges, like a 10 year B1/B2 visa, unless you are subject to additional administrative processing.
