Landed in Canada when wife was pregnant

I just wanted some info regarding a doubt of mine, which is disturbing me a lot. We( myself, wife and kid) got our passports stamped and COPR on June. We booked our tickets for September, and in between my wife got pregnant around August. When I inquired around, got to know that I need not declare the pregnancy as it had happened before the visa was stamped and COPR issued, and we landed on Sept end. But now, due to some unavoidable reasons, my wife and child will be travelling back to India for the delivery. What I want to know is that once we have the baby there, will I be having any issues in sponsoring the newborn, as I hadn't declared it before landing. We have got our PR cards, but I am worried if there are any chances of the sponsorship getting denied. Also, do they loose their OHIP coverage as they will be away for a year or more, and have to reapply once they are back?

As the child was not born before you landed, there was no child to declare and add to your application. You will be able to sponsor normally later.

Can't help you with OHIP, I'm not in Ontario so wait for some other replies on that.

as a PR resident inside Canada you will be eligible to sponsor your baby born abroad.....when you landed there was no baby and no baby to declare.....OHIP card has expiry date, if your family return before the expiration of their OHIP card, they should be okay, otherwise they might have to apply to renew expired OHIP
Tis is incorrect. If your wife and child are only doing a short landing they should not apply for OHIP since they don't meet the residency obligation. They will have to apply when they move to Canada on a permanent basis. There will be a 3 month wait period before coverage starts so they should get private insurance. You should all look into private insurance for their short landing and your 3 month wait time. You can only be out of Ontario for 1 month in the first 6 months. If you are returning to India for the birth you may not qualify as well. OHIP expiry date doesn't mean OHIP is valid if you have not me residency requirement.

I talked to Service Ontario, and they said both wife, child and newborn has to apply for OHIP as they will be out of Canada for more than a year. Will I be having any problems in sponsoring my newborn, say, if I only have a survival job?

I have one more query. The doctor we are seeing for pregnancy, told us that she is waiting for the OHIP coverage to start after the 90 days wait period to do some pregnancy related tests,as they will be covered by OHIP. As my wife is going back within 4 months of landing, will I have to reimburse the amount back, as she won't be there for the whole 6 month period, thereby not meeting the residency requirement?

The Service Ontario people are wrong. I have already attached the residency rules for using OHIP. It is very clear that your wife and child don't qualify and will have to reapply once they return. You are supposed to call OHIP and notify them of a long absence. There was no point applying for the card because they will not be able to use them and then you have to call and notify OHIP of their absence. They will then have to wait another 3 months when they return to Canada. If you know your wife and child will not be meeting their residency obligations you are committing fraud by going ahead and using the healthcare services. Unfortunately government employees are not always knowledgeable but I find it hard to imagine that an employee told you they HAD to apply because they will be out of the country for the next year. Did you explain that your wife and child intend to leave Canada soon and will not meet the all the residency obligations to use OHIP. Yes you could be asked to reimburse any services that you are not entitled to use. It is your responsibility to follow the rules in Canada. You should also inform the doctor that your wife will actually be returning to India soon and will not be meeting the residency requirement to use OHIP. You can either pay for the tests yourself or have them done hen she returns home.

Just read your post again. You were just told that they all have to apply again when they return to Canada in a year. They will have to wait the 3 months again. As long as you show you can support your family you shouldn't have a problem.

If you are in survival job then move your residence to Alberta as OHIP has no waiting period there but still 6 months residency obligation exist. if your baby born in Canada, from the day one she/he is Canadian and it is very good for her/his future. Just my opinion.

So, should I go to Service Ontario and notify them of this issue and ask them to cancel the Health card applied for? I was thinking only of the 3 month waiting period. My bad!
