Good day,

I have a few questions regarding my brother and his wife’s case. My sister-in-law first came to Canada on a work permit and was residing in BC. My brother is a Canadian citizen, and through mutual friends, they met in 2024 and later got married in April 2025.

My sister-in-law was on a two-year work contract but decided to leave her job about 6–7 months before the contract ended, based on advice she received from a consultant. They initially consulted with an immigration consultant for help with the inland spousal sponsorship process but eventually decided to prepare and submit the application themselves.

Her current work permit is set to expire this coming November. They are now considering applying for a visitor visa so she can remain in Canada while waiting for the Acknowledgment of Receipt (AOR), at which point they plan to apply for an open work permit (SOWP).

Would she be eligible to apply for a visitor visa at this stage? If not, what other options would be available for her to maintain legal status in Canada while waiting for the sponsorship process to move forward?

Thank you.
