I have been working in Ontario since August 2012, I have been offered a permanent job and my visa expires on June 26th.

What are my options?

I am a little confused because there seems to be two different types of LMO? Either send to your local Service Canada or all go the NB?

Some clarification would be appreciated...

If your employer is offering you a permanent job offer, the LMO application must be sent to the Centre of Specialization in New Brunswick, not to the local Service Canada office. See the bottom of page 5 of the application form if you wish to confirm this.

Thank you for confirming this, I have sent it to NB. Would you know how long it should take to find out if it is positive or not? My Visa expires on June 26th 2013.

You can call the NB office to ask what their current processing times are. I'm not sure these are published online but they can easily tell you over the phone.

If you don't get the LMO and new work permit in time, there's another option. Assuming that you'll be working for the same employer and in the same job, once you get the Service Canada letter confirming receipt of the application and identifying the LMO file number (this should be within few days of them receiving the application), you can immediately apply for a work permit extension at CIC Vegreville with the rationale that your new LMO is in process (make sure you enclose supporting evidence).

By doing this, CIC will allow you to continue to work on implied status until the LMO decision is known. You can keep working until CIC receives the LMO result and sends you an official acceptance or refusal of the new work permit.

Thank you, I have received confirmation from Service Canada NB that I will receive a positive LMO. Can I use this LMO for a work permit extension through the federal skilled worker program then use the same LMO to apply for perm residency? The FSW program would give me more time to get all my paperwork together for the perm residency.

Slight correction to what you wrote above - you can use the LMO for a work permit extension through the Temporary Foreign Worker Program.

You could also use it to apply for permanent residency through the Federal Skilled Worker Program - but this is more typically intended for foreign nationals who may want to apply for PR before they begin working in Canada (i.e., they are likely to directly apply for PR, and won't transition from TFW to PR).

In your case, since you'll be working for a period of time for the same employer and in the same job when you make the transition from temporary to permanent, you don't technically need an LMO to apply under the FSWP. You just need a letter from the employer confirming that they are offering you a permanent job and stating details of the position. This letter is sufficient for you to claim arranged employment points. The letter and details of your employment will be compared/reconciled with the LMO under which you worked as a TFW to verify that you do meet the criteria for arranged employment. Good luck.

There is also the Canadian Experience Class: if you have at least 12 months of skilled full-time work experience, you are eligible to apply.

Be sure to apply for an extension of your work permit BEFORE the current one expires. This will give you implied status as already indicated and you can continue to work for the same employer until a decision is made.
