Hello!

I am a 20 years old brazilian guy, at first I went to toronto to study english for 8 months in 2010, went back to brazil after that but then I enrolled Vancouver film school to study game design for one year, after studying ... i got a post-graduate work permit, I've been working in my company for almost 11 months now, my work permit is going to expire before i complete 12 months but I REALLY want to continue working for my company, they can't get an LMO because the LMO requirements apparently are higher now, my job falls under a graphic designer position (But really i am a game designer) and I don't get paid the median wage described in the website for this position, so probably my LMO will get refused?


I am just searching for options, can anybody give me any good advice? I really need it ... I've been here for so long and I really love canada and my job.

Don't worry about LMO refusal....it takes 3 to 4 months to get LMO decision...just apply for it at least it will buy you some more time....meanwhile look for another job as well..I am not pretty sure about your field of work just givin you an opinion which might help you. Good luck !

But I guess services canada is just going to extend my SIN for another 2 months after I get my implied status, isn't that right?

Your SIN has nothing to deal with your implied status, your SIN will be valid only till your work permit expires, once you apply for LMO and meanwhile your work permit expires, you can keep working on implied status irrespective your SIN is active or not. Once your LMO gets approved you gonna get new work permit at the same time you need to reniew your SIN. Good luck !

This is wrong.

Employers file for the LMO, not the worker. LMOs also have an application fee now - and if you're paid below what HRSDC considers a fair wage for the job, it will be denied.

If you work while the LMO is in process, but have no application for a work permit, you are working illegally. Report that to CEC and see what happens.

There is NO implied status for a LMO. You can try applying for a work permit without the LMO. It will be refused, of course, but you can try to claim Implied Status while you wait for the rejection. I don't know how CIC would view this, however.

I would apply for the LMO and then apply for the work permit, but is that true that I have to get the median wage for my position in my region in order for me to be able to get an LMO? are they really rigid on that?

Aqui vai o link sobre o que estou falando - pessoas que possuem Post Grad Work Permit não precisam que o empregador faça LMO, apenas precisa de contrato full time job! Sério. Pelo menos é o que esse advogado diz . E diz que muita gente não sabe disso!

Estamos na mesma situação que vc, meu marido tb se formou na VFS em 2012. Só que viemos em 3 e estamos curtos de grana depois de tanto tempo custeando a vida aqui sem ter trabalhado.

Agradeço desde já um retorno seu sobre o que conseguir confirmar sobre esse assunto. Boa sorte pra nós!

sinceramente, estou pesquisando a fundo sobre isso, e o único que escreveu algo que condiz com o que li e que realmente ajuda vc ( e a gente), é o que eu disse acima , e o que uma pessoa depois de mim disse sobre aplicar primeiro pro PNP, acho q pra vc seria easy. Olha o caso desse rapa

You cannot apply for a LMO. Only the employer can.

If the wage doesn't meet HRSDC standards, it will be rejected.

Bud I am not sure which province you are in, but try PNP, its a simple procedure.., you just need salary slips and a letter from your meployer that you are working in the same job from last 11 months, I hope you fall under O, A or B NOC category.

You should apply fro your WP, in like next 30 days or so, but apply for PNP first..if you can get your PNP approved you dont need LMO. I am a BC PNP.. its way better than LMO and other procedures..

Some PNPs require 12 months experience. If you apply with 11, your application will be returned.
