ITA Received and then declined - some critical queries..please help!!

Hi I received the ITA on 13th draw (I had a score of 478) but had to decline it since some critical questions came in my mind which I felt could lead to a misrepresentation in terms of CIC on a later date when I apply. I would be thankful if anyone can answer these:-

1. I have worked in a company from 15 July 2010 to 6 June 2013. This is a bit less than 3 years of experience, but the EE system asked to fill in MM-YYYY, so the time period mentioned turns out to be 36 months. I am being given points for 3 years of work ex and I am not misrepresenting anything. Could this lead to the refusal of my application at a later date by a CIC official, citing that your work ex in actual is less than that according to which you were given an ITA? Or they have, on purpose, designed the EE system to round up work ex duration and hence are using MM-YYYY format instead of DD-MM-YYYY format?

2. I am an MBA from University of Alberta, Edmonton and as they say, a person holding a Canadian degree needs not do his ECA. I have a 4 year Bachelor's degree from India. I know that I am eligible to apply without an ECA, and nowhere in the EE did they ask me for my Bachelor's degree, could the CIC ask for that on a later date, after getting to know that I have my bachelors degree from India?

3. Since I would be applying as a FSW, I need to show at least $12000 in my account. I don't have that much in my account. What if my father send me this money? I know that CIC says that you cannot borrow this money from anyone, but what if my father is just giving this money to me? (I will attach a bank letter saying that the standing balance in XXX's account is $12000, and will not show them the bank statement). Would this work? Would they ask for the bank statement? If yes, how old money would they be willing to see? If they come to know that this money is new, would they be ok by the fact that my father has given this money to me?

4. I may have to change some work ex entries in the new EE profile which I will create now. I have heard people complaining that even if you create a new profile, the EE system issues you ITA based on the old information and when you go ahead with an e-APR, the information shown on the pre-populated sections of the online application is that from the old profile. Does this happen? What if it happens to me? Do the CIC people rectify it if I send a case specific enquiry in such a scenario? This is a problem in their system after all!

5. Last but not the least, if I create a new EE profile, receive ITA, will the CIC people then compare and contrast the information provided by me in the new profile vs old profile? Or will they just consider the newly filled profile?

I know some questions might sound like stupid, but I don't wanna take chance with CIC, so asked all of them.

The system counts month-to-month and that appears to be deliberate. The onus is on the applicant to identify discrepancies (like you did) and decide on the right course of action (like you have done by declining the ITA).
In your next profile, either input months differently so that you don't get 36 months of experience or attach a CSE with post ITA submission explaining the situation.

You don't need an ECA for your Bachelors degree because the system awards you points for the highest qualification.

If you're presently working/authorized to work in Canada, CIC will consider that fact in your favor while evaluating your case. You have 2 options - submit all supporting documents as evidence (work authorization status, job offer letter with salary details, bank statement showing salary credits, T4s etc) along with bank certificate showing monies in the bank even though they add up to less than 12000 CAD along with an LOE that highlights the fact that you are completely capable of managing yourself while in Canada OR take money from your father along with a signed self-declaration from his end which explicitly states that the money he transferred to you is a gift and NOT a loan hence need not be paid back to him. Either of these options should work out well for you.

Not really. Use a fresh GCKey to create a new profile and I'm fairly certain the system won't auto-populate any fields in that case.

No one knows for sure but chances are that they don't do a lot of digging. They do ask for the old EE profile number and UCI when you create a fresh profile so technically they can go back and check. Unless you're grossly misrepresenting somewhere (or did so in the past), you don't have to be worried about any checks.

I know some questions might sound like stupid, but I don't wanna take chance with CIC, so asked all of them.

Hi Asivad Anac, thanks a lot for your reply. I just have two queries now.

1. I appreciate the suggestion of creating a new GC key. But the fact is my PGWP application is pending in the existing myCIC account. Still is it legal and ok to the CIC folks to have two myCIC accounts?

2. Should I really prompt CIC people through CSE that my work ex is a bit less than 3 years? (since I believe that they might have already seen this issue in case of other applicants and would have, by now, changed the MM-YYYY to DD-MM-YYYY in EE system, in case they felt that this thing is causing ambiguity). I am asking this since having 2 years of work ex gives me 453, whereas 3 years gives me 478, a critical difference!! Since I am not misrepresenting anything, just inputting according to the system in place, so would I be ok even if their system is counting it as 36 months? (because I am entering the months and years accurately)

Not sure about legality but it seems in your case that there are clear reasons why you should continue using the same account.

The system is deliberately on a MM-YYYY format because it makes many an applicant's life easier while filling up their profile. Else those applicants will be running around trying to recollect exact dates from their past work/travel which isn't as easy as it sounds at first. In your case, wouldn't you eventually cross 3 years if you continued working - at the same place or elsewhere? And CIC has started counting discontinuous work experience for CEC candidates. So where exactly is the fire?

In simple English, YES.

Regardless of how the system is designed, it remains your responsibility to provide accurate information in your profile AND to highlight inaccurate reporting of information because of a deliberate system design. CIC will hold no responsibility beyond assessing your file and declining it if they find a discrepancy. They might help you out if you report this but I highly doubt that. They will prefer if you apply AFTER having 3 years of work experience.

If my work ex of India is falling short by 1 month, is it possible for me to count the work ex that I gained in Canada while I was on a student permit (Part time of 2 years, NOC B, No. of hours = 2000). I know that the work experience gained while a student does not count while applying under CEC, does it count while applying under FSWP?

Interesting question. I imagine you can add any foreign experience (except Canadian) to an FSW profile - that automatically gets clubbed under CEC.

Hi Ustaad,

I am sailing in the same boat as you.. I declined my first ITA as I had put wrong joining date in my EE Profile.The right joining date was making my 3 years experience short of 1 month. I declined my ITA, made changes in work history and submitted it again. But as you said the system was not able to pick the changes and in my e-APR it was showing the previous dates only. However, In my EE profile it shows the changed dates only. I am going to submit my APR soon. Due to lapse of time I have already completed my 3 years on my second ITA.

So, what happens is when you change information, your EE profile does accept the changes but due to some system error those changes are not transferred to your APR. Your EE profile gets locked after you receive your ITA( you can view but can't make changes), but you can/have to make changes in your APR to make it tally with the details in your EE Profile. I also asked this question and one of the forum member confirmed that he/she faced similar situation and went ahead with the application by modifying details in APR. You can any-day provide a LOE explaining the technical glitch.
