I was working in Canada for an year and created express entry profile with 410 points around June 2016. After that I had moved to US, by Nov 2016 due to arranged employment I had got 50 points additionally (not sure to claim this points if i have to be present in Canada) and received ITA last month. There is a confusion that if I can accept the invitation and submit the document. My legal team says that since I'm not physically present in Canada, I cannot claim that 50 points though my company gives me letter for arranged employment. Instead I will have to decline the invitation and see if i can improve my score by retaking IELTS or return back to Canada with same employer and then accept invitation if the same score is invited again.

Please let me know if anyone have faced similar situation or any suggestion is highly appreciated.
