Hello,

My elder brother went to canada on student visa and after completing his study he got permanent residence card .. now he is doing JOB and living in canada ... My question is as he went to canada and changed his visa status into work permit and then PR card ... and now I want to apply for canadian student visa, Can I get visa or not because as my brother did , Visa officer may be think that I will also go on the same tract as my brother did and wont be back to my home land.....

Please expert advice me , should I apply or turn my donkey left or right way for USA or any other country?????

Dual intent is always allowed and your brother's PR will also play some part but your case will have his own identity and you have to show strong Profile + home ties + finances.........

dual intent comes only when you yourself is a candidate for PR application (under processing) + study permit application. Family history has NOTHING to do with it.

I applied 5 years ago for a canadian student visa but sadly I refused ... at that time my brother was on work permit ... VO said that I will not return to my homeland and my program is also available in homeland ...

now tell me should I apply now ?

I have heard that if someone refused 1st time then he will not get the visa in 2nd time ( very rare cases are who get the good news ) I am sure I am not that one .. I have lazy donkey whose speed is slow and I always reach on decision lately .... now I want to discuss you guys, as you guys have a good and fast donkey .. tell me should I take my donkey straight to Canadian embassy or turn his face to other way?

It is not true that those who get rejection, cant get visa again. I have seen a case on this forum who got visa after 2 rejections. So don't you worry apply in confidence. Remove all the previous objections that were raised on your application by the VO. In order to have no biased analysis of your visa, each time you apply for visa after rejection, your file is evaluated by a different VO.

And yeah buy a horse, it would help you :D
