ISSUES WITH PROOF OF RELATIONSHIP

Dear all,

I recently submitted my application to CIC after I discovered that my point would be 66 which would not be enough to take me through. While expecting that the already submitted application would be refused, I have started putting another application and documents together to be resubmitted before the deadline.

My Nephew who is permanent resident in Canada has now eventually agreed to give all the documents that would earn me additional 5 points under ADAPTABILITY. Her mother and my mother have the same father, however, their maiden names are different as both chose different names of their father.

For instance their father's name was ASHIRU ALIU. My mother's maiden name is ASHIRU Bolaji while my nephew's mother maiden name is ALIU Basirat

My worry is based on the following:

1. My Nephew is a permanent resident whose mother's maiden name (ALIU Basirat) was submitted along with his application under FSWP in the past.
2. My first application has my mother's maiden name (ASHIRU Bolaji)

The checklist require a proof of relationship through a birthday certificate showing both mother's maiden name in this case.

Should I adjust my mother's maiden name to align with my Nephew's mother maiden name (i.e. ALIU Bolaji)?
Or how best do I deal with this ?

Kindly advise.

If your mother's maiden name is Ashiru Bolaji, then any adjustment that occurs without a legal change to her name is fraud. CIC does background checks and if they find out, your application will be refused plus you may be charged with misrepresentation(lying) and banned from Canada for 2 yrs.

If your mom and her sister have the same father, it should not matter if their maiden names are different. Besides, both of their maiden names are still their father's names, just not the same. You can also get DNA tests for yourself, nephew, mom, and nephew's mom.
You can provide birth certificates for your mom, nephew's mom, your nephew and yourself and attach a cover letter explaining everything. If there is a reason why they are named this way, explain it.
Example:

their father's name is ASHIRU ALIU

your mom's maiden name = ASHIRU Bolaji

your aunt's name(i.e. nephew's mother's name) = ALIU Basirat

About the application you have already submitted, is there any way to send more information that can help you get 67 points? Also, if they have not yet started processing the application, are you going to withdraw it so that you don't lose the fees ($550)? Then you can re-apply.

As for the already submitted application. Is there any window for :

1. Sending in additional application to CIC or
2 withdrawal already submitted application from CIC?

NOTE: My application was received October 23 2014 and has not been processed.

1. You said the application will be refused because you have just 66 points, right? So what I was wondering is whether there is any additional document (not application) you can send to that will help give you 1 more point to get the 67?

If the reason for 66 pts is due to your nephew not giving you all the documents to help you earn 5 pts, now that you have the documents, perhaps you may want to send it to CIC and a cover letter asking them to attach it to your application. If you do, make sure the cover letter has your name, birth date, and client ID. I don't know if it will work, but you can try and see how it goes. In this case, you will not withdraw the application.

Or

2. you can withdraw an application at anytime by sending an email, fax or letter to CIC. If you don't think there is any way to send more information that will help you get 67 points, you can think about whether you want to withdraw the application now(and save on the $550), then re-submit a new application with all information.

Thanks a million. I have also applied for ielts so that I can hopefully get additional 1 or 2 points to take me to 67points. Dec 6 is the test date. My plan was to send the test result with another set documents to cic. However if it is possible to send the test result as addition to those earlier sent it wud be nice. Thanks once more.

To be on the safe side, you may want to follow your original plan which was to send the results with another set of documents to CIC. This way, you know for sure that you have everything to get 67 points from the moment they receive your application. Best wishes.
