Hi everyone:

My friend has got a problem about his PGWP and study permit.

His study permit expired in this November and he forgot to renew. Further, few days ago, he just graduated from a college. Can he directly apply for PGWP or he needs to apply for study permit restoration first? But as I know, if he needs to apply for restoration, he must need the school letter, but he just graduated and finished all the courses. What he can do now? Can anyone help me answer it? Thank you.

i think the study permit can be extended up to 3 months after the completion of degree. I remember I asked about it via CIC call centre. I studied in Quebec and I was told in this case, I would not need to renew the Quebec CAQ (yes in Quebec, normally we get CAQ in order to apply for study permit). I would suggest your friend talk to the international student office at his uni to get better advice and check with the registrar if they can provide a letter in this case.

And to your question: yes, he will need to apply for restoration of status and extension of study permit (I am not sure if the application for PGWP can be filed together, but he will need the first two things for sure).

An applicant with a valid study permit and has completed a degree of more than 8 month duration will have 3 months from the time they completed all requirements for the degree to apply for PGWP -- not the time the graduation ceremony is held or the time the diploma is issued (those are of later dates).

Thank you for your answer. But I remember the average processing time of restoration is about 3 to 4 months. I am worried that if his extension gets approved, it still expires and pass the valid date.

oh yes, i remember this concern too: i believe in cases like this, the applicant submits all three things together:
(1) restoration of study permit, (2) extension of study permit, (3) PGWP

but make sure you get at least one more opinion (a professional one hopefully) to ensure everything is in good order.
and during the time he got his status restored/approval of PGWP, he is advised not to leave Canada
[i am not sure if he is on implied status after he submitted the applications--such complicated thing is always confusing]
