I am sponsoring my husband to come to Canada and we are almost done completing the forms. However, on the background information form, they ask some specific questions relating to being refused for past visas, entry, incarceration, etc.
My husband was caught by immigration officials trying to enter the U.S. from Mexico in 2008 (illegally). They kept him in a detention warehouse for 3 hours. ). He was not quite at the border, so they gave him the option to sign a form to voluntarily return to Mexico. He took that option, and didn't have further problems. A few months later, he came back to the U.S. the same way and has stayed there ever since, and has never had issues with crimes, etc.
My questions are: 1. Does he have to mark 'yes' to the question that asks if you've ever been incarcerated, jailed or detained because of spending 3 hours in the warehouse in 2008? And 2. Is crossing the border in the manner he did considered a crime, and could this cause us any additional complications on the application such as having to apply for criminal rehabilitation?
