Is my job offer valid? to get additional 50 points for EE?

I am on a work permit (ICT) in Canada since 2 years with same employer, and I hold a valid work permit till October 2020. Due to age factor, the only way to claim additional points for EE draw is to add a Job offer letter.
Here is the case, I am holding one offer letter from my (same) employer but it was written to Canada Immigration at the time of my work permit extension was filed during December 2018; the offer letter stating that my job assignment will be for next 24 months commencing December 2018.
My question is:
can I claim 50 points for arranged employment using this job offer letter? Considering my work permit expires on October 2020 next year?

Please help.

Probably not. It needs to be an offer of employment for at least one year AFTER PR status is granted.

Do you think this will cause any issue in my PR application?

These are separate and unrelated activities. If you have already got a valid PR application in progress, the application for a work permit should have no impact on it.

If you didn't meet the strict criteria for claiming the 50 points on the day that you submitted the PR application, it will be assessed on that basis, not what happened after submission. If you did meet the required criteria, then the 50 points should be safe regardless if something changes later, including applying for a work permit extension.

@zardoz okay. I did raise a webform recently and explained them regarding my situation and the assignment extension by sending them the new offer of employment. Should that suffice ?

I am very confused about my eligibility to get extra 50 points for job offer for CEC for express entry.

I have one year of work experience in Canada and my work permit is open PGWP which is LMIA-exempt under ‘Canadian Interest” . My employer does not have an LMIA. Do you think that I can get extra 50 point from job offer without LMIA since I have one year of experience and I am applying under Canadian experience class?

PGWP does not fall under Canadian Interests. You are not LMIA-exempt and require an LMIA to claim the 50 points.

It doesn't. You need an LMIA. There is no grey area on that for PGWP holders.

No chance right now and unlikely anytime soon that the score is coming down to 453.

No. But all you would need to claim the 50 points would be a new job offer letter from your employer, offering you a permanent position or for at least one year after you become a permanent resident.

PGWPs are LMIA-exempt. However, for the purpose of having a valid job offer for PR applications, only closed LMIA-exempt work permits are eligible without getting a new LMIA. A closed work permit has a specific employer´s name on it, and you cannot change job without getting a new work permit. PGWPs, on the other hand, are open work permits - there is no employer named on it, and you can change jobs at any time.

So, because you are on an open work permit, your employer would need to get an LMIA to be eligible for a valid job offer.

Requirements for LMIA exempt - you do not meet the first condition.

"if you have a valid work permit for a NOC 0, A or B job that is exempt from needing an LMIA, and you:
  • are currently working for an employer specified on the work permit
  • have one year of full-time work experience (or an equal amount of part-time work) for that employer
  • have a valid job offer from that employer for at least one year after we issue your permanent resident visa

I contacted the CIC again and they said:

For Federal skill worker cases your employer need LMIA for your job offer even If your work permit is exempt and you have a one year experience and AE( arranged employer) is fir FSW. But if you want to get an ITA under CEC you do not need LMIA with your OPGWP, since it is mentioned any employer on your work permit. Also, he said that this condition one ( name of specific employer) is written in general for closed work permit holders such as NAfTA. and since your work permit is open you already cover condition one and “any employer” is written on your work permit.

So I think that only if you are applying for EE under CEC and you have 1 year experience, you don’t need to meet requirement for arranged employer since the word “ any employer” is mentioned on your work permit.
