I have applied for PR under FSW Cat - 3 on Sept 2009 to Nova scotia, but we had to move back to india on Jan 1st 2010 as my contract with Canadian company has come to an end but my work permit is valid till May 2010 . Now i have some queries

1. Is it worth in changing my visa office to Newdelhi from Buffalo?
2. If yes, How long will it take to transfer my application

My details

Application for permanent residence received by Nova Scotia on September 3, 2009.
Received the letter by email from Nova scotia on October 22, 2009

Sent the full set of documents to Buffalo office by Dec 1st 2009
Received the AOR by email from Buffalo office on Jan 13th 2010
 
Hi rmdharan,

Just curious.. What are your options anyway? If you will not be in the US or Canada when your medicals are requested, are you planning to travel here just for the medicals? What is your plan if you are unable to enter US/Canada at that time?

Doesn't it make more sense to bite the bullet and transfer the application to ND right now than to later realize that you are unable to do your medicals and lose the application later?

I'm asking because I might be in the same boat in a few months and haven't decided what to do..
 
Seniors please correct me if my understanding is not accurate.
Medical can be done in any country of choice as long as we have a DMP there. There are two things to consider
1. If you get call for interview, you will need US visa to attend which might be difficult
2. You will need to arrange someone to carry your passport from US to India as mailing it is not legal.

BTW I am in US and gave ND as local visa office since it is faster.

It is extremely unlikely that Buffalo will transfer your file as you have moved. Read the following from the Operations Bulletins.

Visa offices are not required to transfer files for any other reasons. Such reasons include cases of applicants who comply with subsection R11(1) for the specified visa office, at the time the application is received at the CIO, but subsequently leave the territory of the specified visa office. In these cases, the original visa office should proceed with a final determination of eligibility and process the application if eligible. The visa office should not transfer the file to another visa office unless the transfer is warranted for program integrity reasons. Leaving a visa office’s territory alone does not warrant a file transfer. In this case, if an applicant requests a file transfer, the visa office should inform them that the application will not be transferred and that they are required to submit a complete application to the visa office originally specified within the 120 day deadline allotted by the CIO.
