I've just received the 120-day letter for our application for permanent residence under the skilled worked class and have a query about "arranged employment". The guide states that you don't need to supply proof of funds if you have "arranged employment" in Canada, but I fully expect to continue to be employed by my current employer (UK-based office with a US office Seattle) because I already work from home and we already have an office in the same time zone just across the border.

However, I have contacted the Canadian High Commission twice now via email to ask if this counts as "arranged employment", but their first reply only commented on the importance of submitting all documentation on time and the second reply ended with: "Regarding Arranged employment offer, please see our immigration guide", which is not particularly helpful.

So, does anyone know if my situation of continued employment counts as "arranged employment" for the purposes of this application?

Many thanks,
Derek.

It's hard to say because it's not a Canadian employer. If you want to try it, get a statement from your employer saying that they will continue to employ you after you get your PR and move to Canada. If they refuse this "arranged employment" as a proof of your funds, you risk they will deny your application though.

In http://www.cic.gc.ca/english/resources/manuals/op/op06-eng.pdf at page 18, it says that if you have arranged employment as defined in R82, you don't have to show funds.

R82 is in the rules and regulations at http://laws.justice.gc.ca/en/showdoc/cr/SOR-2002-227//20090616/en?page=1 and it looks like it only deals with either an AEO (which would be from a Canadian employer) and people who are on work permits and have a letter from the employer stating they will continue to employ them.

Thanks for the detailed response. I thought this might be the case.

P.S. I tried to follow the link you provided to read the rules and regulations myself, but it redirects to an update notice instead. Do you have the title or something useful that I coudl search for to track it down?

You can try http://laws.justice.gc.ca/en/ShowFullDoc/cr/SOR-2002-227//20090616/en

Or.. go to http://laws.justice.gc.ca/ and it should give you a search page. Under chapter/registration number write SOR/2002-227 and change the radio button underneath to regulations and it should give you a link to it.

When you get there, it will have a scroll window near the top where you can pick different sections of the document so go to 53..115 and click Go to and that will take you to the page where you can see Rule 82.
