Hello guys,

I applied for my spousal sponsorship case a year ago. I was seperated , was done with child custody in Canada and i went back home and got married again. I got my divorce from the last marriage after my second marriage. My second marriage was registered after the divorce but it still shows the date before the divorce. The marriage was registered after i validated my divorce orders from department of foreign affairs and the concerned embassy. I didn't hide any fact from the beginning. My case was refused that my marriage is invalid. Should i appeal or re-apply . I won't be able to sponsor my wife ever? please keep in mind that when i was married second time my ex-wife was already living with her partner. Neither my first nor second marrriage was performed in Canada. I did not conceal any facts whatsoever.

There is nothing to appeal - you were correctly refused.

You need to remarry your second wife. As of now your second marriage isn't valid (and never will be) because you married your second wife before you were divorced from your first wife. Applying again won't fix this - you need to marry your second wife again - this time in a way that will be recognized as legal by CIC.

EDIT: Once you remarry your second wife, then reapply to sponsor her and you should have no issues being approved.

Thanks a lot for your reply. But do I have to re-marry in another country or what. We are expecting a baby in December but it's in the knowledge of CIC because when they asked for second medical X-ray could not be done because of pregnancy.

What explanation do i have to present when i re-apply. Are there any chances of getting refused again after remarrying.

What does it mean : inadmissible

Subsection 11(1) of the Immigration and Refugee Protection Act provides that a foreign national must, before entering Canada, apply to an officer for a visa or for any other document required by the regulations. The visa or document may be issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act. For the reasons set out above, I am not satisfied that you are not inadmissible and that you meet the requirements of the Act. As such, I am refusing your application.
