I had applied under FSW-Arranged employment in OCT 2010.I received the first AOR from Nova Scotia.I got married last year and was waiting for the second AOR from Buffalo to add my husband. But I received my second AOR,medical request and interview call. I emailed them informing my marraige and adding my husband to my file. They emailed back asking my husband to come for the interview with the application forms and the fees.My husband was denied of US visa from India.WE informed again but they still want us to go and if not, say decision will be made on the information provided and may also result in refusal..
I am on my PGWP which expires in the end of May.My company has denied of an LMO.I am not sure wht do you ???Should I go to US by myself (as I have US visa) and explain them of the situation ???Or withdraw the file as after my WP expires I will no longer be eligible for PR ??My interview is in the first week of May.I was thinking to go if there is a possiblity of only me getting PR so that I dont have to go back to India after my WP expires.IF not I dont think its a gud idea to go to US ,spending money for the travel and also $550 for my husbands application fee. What do you all suggest ??

Plz help me with my dilemma.

Can u explain y ur husband was denied US visa & he can reapply from India again ( if not same then different Visa office)

One of the alternatives is to get US visa if he comes to canada and applies again for US visa

They said that they did not trust him that he wld return back...even after showing them the email of correspondence !!! Have an interview in a month ....time is too short for him to apply for Canada visa, come to Canada and then apply for US visa from Canada.
Also since my PGWP is xpiring in end of May...I think he has slight chances of getting visitor visa for Canada.

Smile,

Can you share your timeline? Are you a FSW or CEC (I saw a lot of post from you on CEC)?

As far as your interview. I believe you should attend by yourself (it gives you better chance than simply not attending). And take as many proofs that your relationship is genuine (photos, letter, letters from family, call records, etc). Also take proof of employment and anything that you can use to come out of a successful interview. I think you can still make a very strong case and obtain your PR

Good Luck!

I agree with Rod.

If you dont attend the Interview, then you VO will make a decision based on the info on file and that may not be in your favour.

Attend the Interview with confidence......in my opinion the VO probably wants to nullify or check the probability of "Marriage of convenience " factor. What documents have you been asked to carry with you? It will give you a rough idea about the subject of the Interview.

1. If your marriage was arranged...then bring the News paper advertisement.
2. If its love marriage...then bring in any kind of correspondence, photographs with him and with family.
3. After marriage, if any bank accounts has been made with both of you as Joint holder.
4. Property papers with both of you as Joint owners.
5. Life Insurance with you or him as beneficiaries.
6. His current employment status and proofs.
7. Records of Tel calls.
9 If he is supporting you financially...add those proofs.
8. Your efforts to get him a Visa to attend the Interview......this is important.....because the VO has requested his presence and it was not under your control ....but you tried. VOs are well aware that US visas are tough to get.

YOU CAN DO IT.....attend the Interview fearlessly....you have done no wrong.

ALL THE BEST.

They have doubt about your marriage.
Go for the Interview. If your marriage is genuine and you have proofs then no problem is winning the Interview. Just be truthful.

Timeline for FSW:Arranged employment
Applied to Nova scotia:Oct 2010
Received Aor from Nova scotia:Feb2011
Received AOr,medical and interview from Buffalo:Feb 2012

Timeline for CEC:
Applied:Oct 2011
recieved AOR: Feb 2012 (file transfered to Ottawa)
Recieved medical request: Mar 2012

I am concentrating more on CEC as myself and my husband have got the request and completed medicals.

As for FSW, I am more worried abt expiry of my PGWP (May 2012).Although I have done medicals ...my husbands application has not even been filed as they hav asked us to get the fees and application form to the interview (First week of May 2012).
I am in a dilemma that even if I spent the money for the trip and pay fees for my husband...wld they give me PR as it expires in May end??
There is also the least possibility of me getting PR before May end as my husband is added in my file so we both will be receiveing PR at the same time.

Any more suuggestions???

considering you hv short timelines, my suggestion is to talk to one experienced immigration attorney
They can help u for interview and give u options u may hv
usually they even help in getting thorough paperwork for VO to solve any questions they may have
