Inter-company transfer and job bank

Hi all,

I have just joined the forum and have a couple of questions regarding job offers. I have been working in Canada for 18 months and submitted my application under the old system last year. This has now been returned as the cap was reached. I have completed my EE profile but am confused as to why i didn't get any points for having a job offer. I spoke to a person at CIC and they informed me that as long i could provide a valid job offer letter I would get the points. i didn't. The problem i have is that no LMIA was required as i was transferring within the same company. The company is a very large and well known Canadian company and i was working in the UK office. I arrived in Canada with a job offer and was granted a 3 year work permit that is tied to my job. Now i have received an email stating that i must join the job bank.

I have two questions i hope someone can answer.

1, Why does the system not recognize that i have a job offer even when i go back through my application it clearly say's "YES" to having a job offer. Do the system ignore this offer if you don't have a LMIA or LMO.
2, How can i go into the job bank when my visa clearly states that i am unable to work for any other company or do any other job than the one specified on my visa.

Under EE, Job offer is recognized only when you have LMO/LMIA with it .... then only you would be getting 600 points for it.

This is a big blow to all LMIA-exempted people here. In the EE system, a job without LMIA is being treated the same as no job. Thus, no 600 points and has to register with job bank.

I think what you can do is register with job bank, and reject any offers if some employer wants to hire you. (Or you can accept it and have the new employer get you LMIA approval and TFW permit until PR decision. but it sounds stupid since you already working in Canada anyway)

Your work permit does not say you cannot look for a new job. However, if another employer wants to hire you, they will have to apply for an LMIA. Then you WILL get the 600 pts...

I'm in the same boat, almost. I have an open work permit, and a job I love, which I have held for 15 months and hope to keep. But even though I have a full-time permanent job, I still registered for the job bank because I had to for EE. Honestly, I don't know if I would be interested in a job offer from there, but since I guess it would be in my NOC area, I'd hear what they had to say. I hope, though, that my 466 CEC/FSW score is enough to get pr eventually without an LMIA job offer.

Thanks, yes, we've seen the petition and I have written on student situation if you search the globe and mail site for international students.


Curious about ITC problems.

Hi Mac, I'm in the same boat,my ICT expires in November but I cannot use it as a job offer because it's LMIA exempt. Now my employer is thinking of extending my work permit but I heard they would need the LMIA this time for the extension. Unless I get invited with my 471 points,I don't see any other option to be able to stay.

We(4 of my colleagues) also in the same boat... we came to Canada through Intra Company Transfer (LMIA was not required if ICT in 2012)
We are working here for almost three years, and now we regret for the delay in applying the PR before EE came,
Kindly let us know if there is any solution for the ICT candidates

I'm in excatly the same situation that mak23.
Intra company transfer, so work permiy tied to my company.

I submitted my EE profile but no job offer since I'm already working for an awesome company.
I have 473 points with no job offer.
I was thinking to apply to a new job within my company and have them doing the LMIA process...

Mak23 did you find a solution?
