Inland vs Outland and questions

Hello everyone,

I have been working outside of Canada for almost a year now, and I am planning to move back to Canada next year, with my future wife (plan to get married end of the year). So my concern is how do I sponsor her so we can reduce the time of being separated during application. I am currently a PR.

If she is in her country of origin while we apply for outland, can she come and visit me? when she arrives, can she work and get health care in Canada during the application processing time? Does stage 1 and 2 approval make any differences to her status in Canada?

For applying inland, this case almost indicate that she will have to come to Canada on her own rights, example as she gets her own study/work permits? Can tourist visa work?

If she come to Canada on her own (work/study visa of her own), is outland application the best way to go? We would prefer to be able to travel around (vacation or home visit) during the application process.

I am sure the dilemma of apply inland or outland have been discussed many time in this forum, but after an hour of searching around, I still couldn't find a clear path. Please let me know your thoughts, and thanks in advance

welcome to the forum.
you can find the advantages about inland and outland in the very first thread of this forum, on the top of the list, wirtten by Leon. it would give you a little more information.

as you are a PR - you have to wait until you are in Canada to apply, as you can not be outside of the country for that.
If your wife is from a visa exempt country, she can come and visit you and stay with you for up to 6 months, renewable. If she is not from a visa exempt country, she will have to apply for a visitor visa, and it might be difficult to get - she will have to prove that she has lots of links to her own country otherwise her visa will be denied probably. Most spouses of Canadian citizen or PR get denied a visit visa (because the government is afraid that she will overstay probably as she has a strong link to Canada with you being in the country). So - visit visa is not impossible but hard....

ON a visitor visa - she is only a visitor - she can not work, or have healthcase. stage 1 approval doesn't make a difference... stage 2 is the PR status itself, so once her PR is issued, she can come to the country and immediately work - for healthcare, some provinces have a 3 months period before the person is covered, for others it is immediate, so depending on where you will reside.

If you want to be able to travel, then outland is the only option, as inland doesn't allow the person to travel - otherwise the application will be deemed abandonned, and you'll have to apply again.

Yes. If she needs a TRV to get into Canada, it will be difficult to get one, however. She will have to prove she will leave Canada by showing strong ties to her home country.

For an outland applicant, she can visit you (if she can get in), but she cannot work unless she applies on her own for a work permit. Alberta allows a spouse who is waiting for the processing of his or her PR visa to get health coverage. Most other provinces do not. For outland, stage 1 and 2 don't really make any difference to the applicant. She'll just be a visitor.

If she comes in on a tourist visa, she can then apply inland.

If she wants to be able to leave Canada and reenter during processing, an outland application is best. If she needs a TRV to enter Canada, then leaves Canada and tries to get a new TRV, she will probably be refused, and then the inland app is over.

We are from Beijing so she will have to get visa to go to Canada then.

I am pretty sure at this moment that she will need to get her own study/work permit to go to Canada, then I sponsor her for PR through outland. This way, we are free to travel, and when she is in Canada, she can work or study instead of doing nothing because she is not allowed.

I guess my last question is, once she is in school under a study permit and I apply PR sponsorship for her, is that going to effect her own permit in anyway? Say her study permit run out in a year and our application is still under process, what can she do? can she get an extension? or she has to leave Canada and try to come back with a visitor's visa. I had US friends trying to sponsor his wife, the issue was her study permit was not renewed because she is trying (under her husband's sponsorship) to immigrate to US. I know US and Canada are somewhat different. I mean, the whole reason why she gets her own study/work permit is so we can stay together in Canada, and not wasting anytime while waiting for PR approval. Is this going to create any issues with Immigration Canada?

i am a PR and will return back to Canada soon with my wife who I obtained for her a TRV, then I am planning to apply for sponsor her INLAND immediately and the ""health card"" is the most important issue for me since it will cover the baby delivery which will cost me thousands.

My question is, can i go to ALBERTA and apply for my wife INLAND to my wife from there??? knowing that i did landing in ONTARIO and i obtained my PR from ONTARIO! please advise me

Your question reminded me about having baby when applying PR. Say we do get married and moved to Canada. What if we decide to have a baby when our PR application is in process? Do we need to withdraw our application and do a new one?

You can live anywhere in Canada you choose once you land (not sure about Quebec). So where you land would have no bearing on your wife's case. But you should read up on it each province has there own do's and dont's... like Quebec covers pregnant PR's immediately but they require that you remain in Quebec for 6 months after birth or you must repay it...

No, but you will have to inform CIC that a child was born... if the baby is born in Canada the baby is Canadian.

You need to live in Alberta to have healthcare. If you move into Alberta from out of the country, you are eligible immediately. However, you will need to apply at a local registry. If your wife needs to see a doctor before you are approved, she can go anyway. Once you get your healthcare card, you can ask Alberta Healthcare to reimburse medical expenses. I live in Calgary with my husband who is Canadian. The woman at the registry told me when we applied for our marriage license I would be allowed healthcare when we applied for the marriage certificate. I'm hoping she was correct!

FYI, healthcare does NOT cover the cost of the immigration medical exam. You will still need to pay out of pocket for that. I've been quoted a price around $200.

So, does Alberta grant a health card immediately or there is a minimum waiting time?

I sent email to ALberta health care but still waiting their reply and have to take fast decision.

The absolute best thing to do is see what Alberta Healthcare says. The way I read their website, as long as you are a PR and she is your legal spouse, she is entitled to healthcare the day she moves to Alberta. However, in my experience, when I applied originally for healthcare, the woman told me I would need my approved in principal. (This was before we were married and we had no common-law declaration because we were planning to get married.) When we applied for our marriage license, the woman at the registry then told me as a spouse, I would qualify for healthcare. The real test will be in a few weeks when I actually go to apply again. (We were only married last weekend and must wait 3 weeks to get our marriage certificate.)

Another thing you can do is call the Registry directly and talk to staff there. Google search the name of the city and "registry." If you're going to live in Calgary, you can call Mojo's (403) 252-3333 or Southland 403-255-3653. There's lots more in Calgary... those are just the two I know. The staff at both are very nice and friendly.
