Hi!

I am a Canadian citizen, my spouse is from Mexico and we just sent the PR common-law sponsorship application in early March along with the application for an OWP. His current status as a visitor expires end of May of this year - he last entered the country end of November and he has 6 months. Took us a bit of time to put the thing together properly. Does he need to extend his visitor status at least 30 days before it expires or not because the application is sent and he is awaiting the OWP?

To add to this, it appears they didn't stamp his passport when he last entered Canada via the airport in Calgary before moving on to Victoria, BC final destination. Is this common? We're not sure what this means for us because it seems that there needs to be some kind of document to prove his current status when applying for this visitor extension?

Any help is much appreciated!! I've searched and searched online but there is SO MUCH information it's confusing!

Thanks!!

Hi! If your partner entered Canada at the end of November, may I ask when was the 12 month period of cohabitation? Yes, you should apply for a visitor record to extend his status in Canada if you dont hear back about his OWP/AOR by the end of April. However, judging by the spreadsheet, it is taking an average of 47 days to receive AOR for inland Feb applicants and the trend has been OWP approval about 10 days after that. So, hopefully beginning of March applicants hear some news soon because I also applied inland on March 5. If you dont hear anything by the time there is only 30 days left in the odd chance that his OWP is refused, which would put him out of status.

It would be a good idea to apply for a visitor extension in May closer to the expiry of his current status. This is a back-up in case the OWP and/or PR is returned.

It's very common to not get a stamp when entering. He can just state his entry date and that he did not get a stamp.
