Inland Spousal Visa Queries

Hi,

I have a concern here. The inland process says that the applicant has to be physically present in Canada during the process of the application.

Let's say the sponsor (currently PR) wishes to apply Inland for her husband (with one dependent child), will both of the applicants needs to be present in Canada during this process?

However, which process is usually faster, Inland or Outland?

Appreciate your response.

Regards,
Hemant

If the sponsor is a PR and not a citizen, they do need to be residing in Canada through the duration of the application process. To have a valid inland application, YES, the applicant must be present in Canada, preferably with legal status (as a student, visitor, or worker; out of status applicants won't be denied automatically but they will definitely wake a closer look at you). If the applicants cannot come to stay in Canada for the duration, you cannot apply inland.

You'd have to check the tracker to see whether inland or outland apps are currently processing faster, but every application is different, so even if the way you apply is currently processing faster that's no guarantee that yours will. They give you an estimated processing time of 12 months for both inland AND outland apps for a reason.
