Inland Spousal Sponsorship Question (on ETA)

Hi guys!

Thanks for creating this forum. I have a couple of questions i'm hoping someone can help me with, i'll try to make it as clear as possible.

1. My girlfriend is korean and is currently here on an ETA (electronic travel authorization). According to the Canada government website, unless indicated in your passport, you may stay up to 6 months in Canada on an ETA.

I'm wondering if anyone has any experience otherwise? The customs officer simply left her passport blank (no stamp or date indication). We are thinking this means 6 month stay period, but just wanted to see if anyone had different experience?

2. We are in the process of getting our marriage certificate, we are estimating we will receive it in 2 months, which means she will be 3 months into her stay in Canada on the ETA at that point. We have all the other required documentation and will be submitting an inland sponsorship application and the OWP as soon as we receive it. The question we have is: at 5 months into her stay here, will she need to renew her ETA even if the sponsorship application is in progress? The main reason is she does not want to leave canada and then come back, because it's possible they might not allow her back in again.

3. Regarding her OWP, she will need to wait until it's officially approved to be able to work correct? (i heard some conflicting information about this, someone mentioned simply applying will allow them to work) Since she is currently on ETA and not allowed to work.

ETA isn't a visa or right to stay in Canada. It's a authorisation to fly into canada, and are usually valid for 5years. U won't have a stamp for this because it's not a visa. You need to look at visa information for how long she can stay. If she is from visa exempt country then I believe it's usually 6months you can be in Canada for.

Hi

1. No stamp = 6 months visitor status. The eTA has nothing to do with her status in Canada.

2. Submitting the OWP app with the inland PR app will maintain her status. Many apply to extend their visitor status as well, just in case the PR/OWP app is returned.

3. She must have the OWP before she can work. Any work done while only having visitor status would be illegal, regardless of what she has applied for.

How long have you been dating for?

As mentioned, this has absolutely nothing to do with eTA (this is only for boarding an airplane).
