Hi all!

I have a question regarding the sponsorship + visitor visa.

My husband arrived in June 2010 (US Citizen, no special passes required) and had no problems coming through. They didn't even stamp his passport with a date to leave.

We want to apply inland for his PR but we are still waiting on his FBI prints to come back. For all we know we may not get them until January. Needless to say it's delaying us from sending our PR application in and time is also running out on his visitor status. I'm going to have to apply for an extension by December which is fine, I can do that.

What I don't understand is that how many times can you apply for extensions? I was under the impression that with extensions, the maximum he can stay is one full year. But thanks to the FBI, we are going to be applying at the 6 month mark of visiting; it will take 8-10 months FROM THAT POINT just to get phase one approval. That is way longer than a year.

I hope this is making sense. If you need clarification just ask.

So if this takes longer than his maximum stay of one year, is he going to have to leave and come back again half way through? I read that leaving while your application is in process is really a bad idea and you risk having your application canceled and entry denied. But yet he can't stay longer than a year sooooo yeah what do you do? He hits one year in June 2011 and it looks like his phase one won't be complete until Sept/Oct 2011.

Can he apply for another extension past a year? Or does he just wait it out and hope they don't get upset?

I'm a student and we are living with family members until I finish university; I'm trying to avoid costly trips back and forth to the states; though if we have to we have to. My biggest concern though is that if he travels there is always the possibility they won't let him into Canada again if they get "suspicious" even though we are well within our damn rights to apply for PR and have him stay 8months.

Thanks for your help, I'm finding this educating in the least. When I got my PR in the USA, while I waited for my greencard, I just stayed past visitor status of 6 months (It took like 3 friggin years) and they never said a thing. It was pretty standard. Here it's like the opposite. ::)

I'm going to throw in one piece of advice that you will certainly hear from many others... If your husband is a US citizen, you need to seriously think about applying outland. You could be completely done in 4-5 months - even less. (See my timelines.) My husband was "visiting" Canada the entire time our application was being processed. If you apply inland, it's 8-9 months just to complete the first stage of processing.

Yes apply outland.. and it will be much faster. And he can come to canada, when ever he want to visit you.

Alright we can do that. Hopefully he won't have to fly back to do any interview. Can he still do the medical exam and other things from within Canada?

Yes - he can certainly do the medical in Canada (that's what my husband did).

I have to agree with the other posters, apply OUTLAND, your husband can still be with you in Canada and the whole process is going to be over way sooner than 10 months. :)

But once PR approved.. He has to go outside Canada, and enter back in. He can also do flag polling at any Canadian Border. But after issuance of visa he has to go outside and come back in.

You can wait till December and then apply.. As it will buy you more time, and your husband will be under implied status. Just keep all the forms ready. :)

Amusingly enough it's going to take over 90 days to approve his extension. I love how they tell you to do it 30 days ahead....I guess they think they will finish it before the 30 days are up. Silly government. ;D
