Hi, my fiancé is an American and we plan on getting married and then applying for his permanent residency through spousal sponsorship. My question is: are we able to apply with an inland application? My understanding is that you can apply as inland if you hold a work visa, student visa or visitor visa. Americans don’t require a visitor visa to stay in Canada, so it seems like a gray area and I’m not sure if it still counts. Is anyone able to clear that up for me?

Yes - you can apply. There's no grey area. Even those who are out of status can apply.

An American here under their passport is regarded as having valid visitor status.
