I am aware that if doing Inland Spousal Sponsorship you can get work visa usually after three months. My question is does it ever take longer than three months to get the work visa? If so what's the longest it could take to get it in worse case scenario?

It's typically four months (not three). As long as you are in Canada and have valid status, the processing time shouldn't exceed four months.

There's always the possibility of complications (e.g. application package is incomplete and is returned - and you have to fix the issue, resubmit and start the waiting time from scratch). If you accidentally fall out of status in Canada before submitting a full / complete application, then you won't qualify for the OWP pilot and will be waiting until you have AIP to qualify for the OWP (which would be a number of additional months or even well over a year if your application ends up with the Etobicoke office for further review because there are concerns with your application). So true worst case scenario is 1-2 years.

How does someone accidentally fall out of status?
It's pretty easy. Unfortunately we see quite a number of cases here.

- They come for a six months visit
- They submit an inland application with an OWP before the end of their visit which gives them implied status until a decision is made
- Application is returned as incomplete (missing signature, outdated form, missing fee, etc.) and is received after their visitor status has expired
- Person is now in Canada without status

For the above reason, even if someone is submitting an inland application + OWP, we always recommend they still extend their visitor status until they know the application has been accepted as complete.

To Scylla. Thank you for the information provided. If I was married in 2014 & applied for Inland Spousal Sponsorship & got divorced & cancelled the application does that mean my chances are very high of my application getting sent to Entobicoke this time for further review?
