Inland PR application - Visa Extension

hi,

I`m about to send soon my Inland PR application, I am here in Canada and extended my visa already, my question is, what happens, if one apply Inland for PR and the visa extension is denied ? I was reading, that I`m not suppose to leave Canada while the application is processed, not even for a short trip to the states, since there is always the risk of being denied entry when coming back.

if you send in an open work permit with your inland application, you will then have implied status until they issue the open work permit, so you won't have to worry about extending your visa. For the most part, extensions are rarely denied for PR applicants, so i don't think it's something to be concerned about.

Hi rhcohen2014,

I have the same situation that my spouse's PGWP may expire before get open work permit. Do you know what happens for staff like health card, drive license, sin card when you have implied status ?

thank you rhcohen ! I definitely will include a open work permit :) How long is it gonna take until a decision is made from cic ? I thinks its called first stage approval ? And is there also a sponsorship approval included when I get my first answer from CIC ? I`m from a visa exempt country from Europe.

for inland applications, the first stage is called AIP, which is when they evaluate the sponsor and the relationship. The current wait time for this is about 11 months. Once approved, the open work permit will be processed and you can start working.

so the first time I`m gonna hear from CIC after I send my application is approximately 11 months ? thats gonna be a long time of unpatient waiting ::) but as long as we get that first stage approval the waiting is worth every minute.

no, not necessarily. generally inland applicants get an Acknowledgement of Receipt (AOR) from CIC about 4 months after submitting the application.

hello again,

so I just wanted to make sure, that I do the right thing. Just to confirm, I CAN include a Open Work Permit Appl in the Inland PR Application ? And aslong as there is no decision made from CIC (until I hear back from CIC) I am still under implied, legal status in Canada ?

What country are you from? If visa-exempt, you are most likely much better off doing an OUTLAND application.

I am from Austria, so yes, I dont need a visa for Canada. My Husband and I want to stay together for the duration of the PR application and since I am already here in Canada its all settled for the Inland Route. The only question (for now) is, if I can include a open work permit in my PR application and if I am on implied legal status till a decision is made by CIC ? rhcohen already answerd me on that, I just want to confirm a 100% if its ok, to do so.

You can apply outland and remain in Canada as well. You'll probably receive your PR faster than it would take you to reach AIP... inland takes double the time.
But yes, if you submit the OWP application with the inland application you will be on legal status. You can do this 100%.

wow lellen, I did not knew, that I can apply even trough outland, while i am in Canada ! I must take a closer look now, whats the diffrence (expect of the shorter waiting time !). So I would send my application from here to my embassy in Europe ? I will be back soon with some more questions.

No, all outland applications get sent to Mississauga for sponsorship approval, then CIC will forward it to the appropriate Visa office overseas, depending on the home country of the applicant. Besides the wait time, with an outland applicaiton, an applicant is free to travel outside canada during the process, there is no risk to having the application cancelled on the rare chance the applicant is denied re-entry to canada, and there are slight differences in the forms and supplemental documents. For most applicants, the difference in wait time is enough to convince someone to NOT apply inland.

That's right. I am in Canada right now, I applied inland and regretted so much every day, especially because processing times were getting longer and longer and I didn't want to feel like I was "trapped" in Canada. I withdrew it, applied again outland, and now my application is in the system two months later, we're expecting to receive sponsorship approval next week. I strongly recommend applying outland.
