Indian Spouse sponsorship - Please help

Hi all, I am Raasmi and am an Indian and in the same situation of Bhuvan!

I becmae PR in Sep2012. And had been to India for short vacation and got married and came. Can I apply immediately for his sponsership now? I have all the documents linke marriage certificate, my companies offer letter (to show I have 40 hrs/week).

It's been 8 months I away from him (as ours is love marriage) and now again even after marriage, we sould be away for another 10 months? This is killing us.

He has work permit from his compnay from India to enter Canada now, but they are not providing a date due to some political internal issues. This is been since 8 months and we are frustrated to the core being away like this for years and years!

Please help let me know 1. if I apply for his PR here and in between if he enters Canada on work permit basis will there a problem to his sponsership process?

2. Can I apply for his sponsership now and allow him to enter canada when his company provides him a date (hoping to as he is holding WP until Dec 2013.

Hey,

If you are a PR, you must be in Canada to sponsor your spouse. As it seems to be the case, you can go ahead and sponsor your husband.
Just fill out the papers, have your spouse fill out his share, and send everything to Mississauga.

The work permit process from his company is a different matter, it won't affect his PR. So you can apply now, the outland route, as he is not in Canada. If he comes to Canada with his company before the PR is issued, better for you as a couple. He can be in Canada on a work permit, AND have a PR application being processed outland - the 2 processes are not linked.

The only issue he will have is that New Delhi will ask for his passport. Indian passports are not allowed to travel overseas by post, so you would have to arrange through a family member etc... the issue is that since New Delhi asks for the passport in the early stage of the process, your husband will be in Canada without a passport for a while. If his work requires him to travel for example, that might be an issue.

If he is in Canada on a work permit and his PR is issued, he will have to exit Canada and re-enter to "land as a PR" - but that can be done at the nearest US border, so it's not an issue. If he doesn't have a US visa, it doesn't matter, he can ask for an "administrative denial" when exiting Canada and entering the US: he will exit Canada, then turn around and re-enter to "land as a PR" - at that point his WP from his company will not be valid anymore, but it doesn't matter, as he will be a PR right away and can work with his new status.

Thanks alot for your information.! Yes Initially we thought it's goin got be easy but he had to move a differt province completely inorder to get a work that will make him eligble to come to Canada and they told they will sen din February as you might need to apsnd 3 months initially there. since then we have been waiting and it took 6 months long to apply for his WP and WP has been issued in March, but they are not giving him a date of travel yet!
It's being so frsutrated for us to just to wait hopelessly without 'Yes' or 'No' answer from them. It's a pain!

And for me handling my kid all alone is becoming more and more a worse pain here. We are just waiting, waiting , waiting but nothing is happening!!!

Yes, I am in Canada itself now. Based on your above information,can you pleselet me know if all my paper work gathering etc are done by June and I apply by end of June, when would Delhi hig commission would ask his passport and how long (how many days/months) they might hold it?

Have any idea please!!?

Hey,

The waiting part is painful for sure - for PR applications it's the same! so - just be prepared for it.
It's difficult to know how long they will hold his passport for etc. If you send all the papers in June, the first stage will be done most likely in 1 month or less. That's the part where they approve you as a sponsor. What you need is fairly straightforward: proof that you are settled in Canada, and no criminal background, as well as some way to support yourself and your husband. Since you're working, that should be fairly straightforward.

Then the file goes to New Delhi. http://www.cic.gc.ca/english/information/times/perm/fc-spouses.asp according to the website, New Delhi can be up to 10 months but quite a few applicants get done way before that. If you have a straightforward case (first marriage for both, no previous sponsorship, marriage according to Indian customs, proofs of regular communications, ), it could be done before that. There are quite a few "new Delhi applicants" thread on this forum with spreadsheets etc. New Delhi seem to ask for his passport shortly after the file is transferred to them, so potentially for you in August (apply end June, sponsor approval end July, and transfer after that). After that - they will keep his passport until the PR is approved. Can be 3, 4, 5, 6 months - it really depends on your file....

From what I understand, your husband can also delay sending his passport if requested, if he has a "good reason" ( like : moving to Canada for his company!), but it might delay the process a little... so there is no easy solution and easy answer to your question.

Hi Again,

Am back! I tried to reply to the thread of 'New Delhi 2013'... but I was not able to find a way to post anything.

Second thing, I analysed the spreadsheet 2013 and 2012. Cases from 2013 have not been updated with how long they might hold the passport at Delhi after they request the PP.

All I see is they have taken wihtin 1.5 months to approve the sponsorship from the date of submission of file. And they have requested the passports in 25 -30 days on an average.

But we have many constarints since I don't know if I apply now if I should apply as outbounbd or inbound since he haven't come yet here. Even if he comes his Work permit is expiring in Dec2013 and if his passport is requested by Delhi commission by Sep 2013 (considering the fact of applying/filing for his sponsorship now in 15 days or so) we will held up with his passport thier and he might face problem from his company or the Canada govt to get his WP renewed to stay in the country (since he looses his eligibilty to stay here) nor to go out of the country.

So for that I need to first know how can I be a part of that threas to post or ask anything. Please advise which will be of great help!

When you go to any thread, at the bottom, there is a "reply" button in the last post. Click on that, it will open a new window - just like you did here. Just go to the last page of the thread first (see the numbers on the top of the thread), and it will become more apparent.

You can not add anything to the spreadsheets - they are protected and most of the time one person is in charge of the editing. The information is usually fairly accurate, once the passport has been requested they will put a date. So for 2013, if there is no date, then it means that the passport has not been requested yet. according to the colors, you can also see which applicant has had the passport request etc. First stage approval timeline varies, and is posted on CIC website, it's fairly accurate. Average now is 1 month.

You can only apply inland once your husband is in the country. If he comes to Canada and you apply inland, you should apply for a work permit at the same time - he will get implied status and he can stay in the country as long as his application is being processed. After the first stage (6 months for Inland) he will get an open work permit. depending on what type of work permit he will come with, his WP can be extended by the fact that he has applied inland ( read the first thread by Leon, only the first page, for more info on that).

Many things to consider for sure!
