I have to apply for OCI but my income tax conflict is pending. It says that there is a due amount of 70K rupees. My CA in India has challenged it as it’s not due to my fault. My employer gave me wrong Form 16 and by the time they notified us and sent the revised form 16, I had already filed my taxes and paid the due amount. After the assessment, the ITA department told that I will have to pay 1 lac more which(ideally it should have been 30K only as per my CA and I did the math too). After lots of follow ups and no response from ITA team, we paid the 1 lac amount. Now 2 months after it was they cleared sent me a fine of 70K as I paid after due date(I paid late as that amount wasn’t correct). Long story short I want to address this with income tax officers till this gets resolved as it’s not my fault. I have always paid my taxes on time. But I am applying for OcI in the next few days. Due to think it will become a roadblock? I don’t want to end up paying 1 lac 70 thousand of my hard earned money(when ideally I was supposed to pay 30K) when it’s not my fault and want to fight my case. But on the other hand I want to get OcI asap so I think I should just pay it off. Any suggestions?
