We are about to finish and send our papers but problem is sponsor was jailed for two months three yrs back. But the answer to sponsor eligibility assessment from 5-18 is no. Form imm 1344. it is not violent nor sexual offence. And it was already cleared. Would it affect sponsorship? Since it was not stated to check the box if ever he was in jail. Should we attach jail documents? Is he still eligible to sponsor me. Or should we just ignore it since it is not in the question if he ever did go there. and proceed. Thanks

You should answer the questions on the form exactly as they are stated. The CIC will be privy to your sponsor's arrest record, and having a criminal record will not disqualify him from sponsorship. They want to know if the sponsor is incarcerated currently, or if they have been convicted of a serious violent crime or sexual crime. If your sponsor's past criminal issue did not fall under this category, then honestly answer no. The question is whether or not the crime that was committed had the potential for a sentence of 10 years in prison, even if that sentence was not applied. Your sponsor should verify that their offense did not fall under this category (which is serious criminality). As long as the answers to those questions are all no, then there should be no issue with your sponsorship.

Thank you for answering. So you mean to say if the answer to all those questions are no, we better not mention it at all in the application? It is only two months and he already served and was cleared. But there is a two months gap in the job section and not really sure what to put there since that was the time he was arrested. Are they doing a background check for sponsors regarding this matter? I'm afraid this would lead to misrepresentation.

No, I mean that you should answer each question honestly as it's presented. If the answer to a question is no, then put no. If he was in jail for 2 months, then on his job history you put during that 2 month gap that he was incarcerated. On his address history, you should include that address during those 2 months and note that he was incarcerated. They will verify that the sponsor's information and criminal check are in order. So yes, if you leave the info off where you need to include it, that's a big problem. But you don't need to add info, just answer the questions with the information that they are requesting. If they need more, they'll ask for it.
