I need real help, I am in Big Problem.
I am in Canada I am PR. My mom applied for Visitor Visa (TRV) online on 23 April and we got the Biometrics request. My mom went to VFS office Delhi India for Biometrics on May 7th, she was carrying all her documents just in case because this was the first time she was applying for Visa.
The officer who did Biometrics asked for all the document, my mom told him that She already created online Application and Already paid Visa and Biometric fee. But Officer told her ya thats okay and took all the papers and the payment receipt (Payment receipt which we already paid for online application)
Next day Biometrics uploaded on the Online Profile. And on 8th May Mom received call from VFS that why she submitted all the papers when she already applied online, Mom told them that you officer asked for it and they said ok they will take care of it.
But after few days we revived the email that new paper application got created on her name.
I tried calling VFS and Also send email to delhi immigration but got no reply, VFS said please contact Delhi immigration as VFS cant do anything now.
After few days I received email on paper application stating below:
I am not satisfied that you have fulfilled the requirement put upon you by section 16(1) of the Immigration and Refugee Protection Act, which states:
16(1) A person who makes an application must answer truthfully all questions put to them for the purpose of the examination and must produce a visa and all relevant evidence and documents that the officer reasonably requires.
You have submitted payment receipt O231138526 showing a payment amount of $185.00 in support of your application. This receipt has been verified in our records as having already been submitted and used on your previous application and is lacking the fees required for the services requested. I am concerned that your submission of this document in support of your application was liable to induce an error in the administration of the Act concerning the completeness of your application and your eligibility to be assessed for the requested visa. I am therefore concerned that you may be inadmissible to Canada for misrepresentation.
I replied to them explaining everything that happened, but dint receive any reply from them, I again wrote to them after 1 week but still no reply.
Meanwhile my online application got refused stating that we failed to provide Biometrics, but I still see that Biometrics is updated on my Online Profile. I again wrote to them but no reply.
And after almost 1.5 months on Paper application I got the confirmation letter that they received the Biometrics and next day I got refusal letter on paper application stating:
• I am not satisfied that you have truthfully answered all questions asked of you.
• You have been found inadmissible to Canada in accordance with paragraph 40(1)(a) of the Immigration and Refugee Protection Act (IRPA) for directly or indirectly misrepresenting or withholding material facts relating to a relevant matter that induces or could induce an error in the administration of the IRPA. In accordance with paragraph A40(2)(a), you will remain inadmissible to Canada for a period of five years from the date of this letter or from the date a previous removal order was enforced.
I DONT KNOW WHAT TO DO WHERE TO GO WHOM TO WRITE, clearly no one is reading emails at delhi immigration, My mom provided everything truthfully, it is mistake by there department and they are punishing the applicant.
Guys please help me how I can rectify this, whom I can contact, I have proof of everything what all happened.
I know noone read emails at Delhi immigration.
Please provide if I can call someone, I am in Ottawa if I can meet someone here. Because it is so messed up I need to talk to someone to explain my situation.
