In the event of PPR and spouse in India - Need your thoughts

Hello Folks,

I am expecting PPR soon for myself and my partner who is in India. I work and live in Canada. My question is whether I would be able to send both our passports to Ottawa and then mail her passport back to India after the Visa stamping? I am sure this has been asked before. What options do I have?

No...You would have to ask CIC to change her visa office to India. They do that pretty quickly these days. Technically she cannot mail you her passport (one country to another).

No worries at all. When you get your PPR, you can email ottawa on the request, i.e your wife being in India and the need to have her passport stamped at the closest LVO to her. That way, your wife wouldn't have to mail her passport to you in canada.

Thanks for the responses folks. Just to add to my situation, I brought her passport along from the recent visit to India. I called up Fedex Canada to check if I will be able to mail passport to India, for which they said Yes I can do that. Now that I have her Passport with me here, can I not just send both our passports directly to Ottawa office?

Now, I am not sure. I think it should not be a problem. At the same time CIC may question what the passport is doing in Canada without any valid visa. You should not have bring it. Keeping other person's passport is illegal without his/her consent.

Wow, never thought of that. Good point though. What do you suggest I do? Should I call CIC and ask?

Please mail your wife passport back to her and follow the rule of changing the Visa office. Don't tell CIC that you have your wife passport; it’s a crime to carry another person passport from one country to another country when they are not physically there

Thanks Vinodram. Funny thing is I had her passport at all the international airports from India to Canada and none of the security folks even asked me a single.

"This passport should not be sent outside of any country by post. This should be in custody either of the holder or of a person authorized by the holder."

You just need to have an authorization letter from your wife and you can sent passport for stamping in Canada .

But you cant sent it back to India via Fedex as it's against rules. For that you will need to find a person travelling to India , and your wife need to give another authorization letter for the same.

That is correct.

Thank you! Could you let me know the source of this information? Also, how would CIC know that the letter has been written by my wife. I can as well type it myself. Just trying to look at this from their lens. Should I ask her to email the letter to me and take the print out of the email along with the Passport while mailing it to Ottawa? Sorry for throwing so many questions out there. Just looking what best I can given the situation.

Source - These are written in the back page of every Indian Passport. The rule is from Indian Passport act which is pretty old and needs amendment.

Authorization letter is not CIC requirement , you dont need to sent it to CIC along with the passport . But make a letter in India (if possible notarize) and keep it with you guys on her first visit to Canada using this visa . The Indian Immigration could (very rare) ask her the way she acquired the canadian VISA stamped from Ottawa canada, on that case she can explain the details to them using this .

These all are just precautionary measures to avoid future complications in Indian Airports . This has nothing to do with Canadian Immigration , Airport or CIC.

Highly appreciate your response. I will prepare an authorization letter and get it notarized and signed from my wife. This is feasible as her passport is with me and I also found out that I can not mail her passport to India due to restrictions. The only catch is that I will have to visit India and complete the landing formalities with her. Thanks again!
