HI,

My employer cannot get me an LMO, so i cannot currently get another work permit.

I spoke to a lawyer who to told me to apply for an extension of my work permit even without the LMO, 1-2 says before my current work permit expires. this way i should be able to get hopefully 6 weeks of implied status.

however i have now read that i must apply 30 days before my current visa expires...is this the case? if so implied status would only give me about 2 additional weeks here.

does anyone have any experience/advice?

When does your current status expire? If your status is still valid, send an application now. But what do you wish to gain with having an implied status? Change/Extension of status processing is now 60 days as per CIC website.

So you would have been working in Canada for 22 months by June 30? Has LMO been filed for you? You don't have to send your application right now but send and see to it that it is received by CPC-V on or before June 30.

no i will have 22 months by mid-August, therefore by the time my implied status will likely end.
my employer will not try to get me an LMO, so I realise that the permit will be rejected.
I am just trying to ensure that i get as many months work experience here as possible before i leave (and also i want to spend as much time as i can here).
so i could maybe send my application on june 23rd?

As long as CIC receive your extension BEFORE the date of your work visa expires you will be in implied intent status.

I would send it a week before your expiry date to ensure it gets there, making sure the application is signed for. (You can track this via the net and download proof of delivery)

At this time, CIC are taking anywhere up to 90 days to review and approve or deny work visa's, usually the time frame is approx 60 days, but you are legally able to work under the same conditions of your current work visa, until you get notification from CIC to stop working.

Hi there,

My situation is similar to yours; my work permit expires in aug 2nd week. I was previously on a work permit after a positive LMO, but this time it got rejected.

My PR application file is in process; currently awaiting medicals - i wish to do the same..just send in an application for extension during the last week so i get another 60 - 90 days of implied status. I wish to get an answer on my PR application by then.

hi some of my questions are already answered but had not read anything that says your temporary visa will also expire...i also planned to submit my extension weeks before expiry but my TRV will also expire same time as my work permit...so just wondering if I could get my permit extended without renewing my Temporary residence visa...Thanks.....

Hi,

Yes, you have to extend WP/apply for a new WP before you submit your application for a new TRV. Your TRV is sometimes co terminus with your WP.

No. You need to apply for restoration or leave Canada. Either way, you can't work.
