Implied status while waiting for ITA ?

Hi Guys.

I have 453 points and an LMIA in the pipeline (prospective total of 1053 points)

My CEC visa runs out in two months. I am waiting on either an ITA draw below 453 points or for the LMIA to be granted.

Either way I think my partner and I will be needing to find a way of going on implied status.

Any suggestions ?

First, what do you mean, your CEC visa runs out in 2 months???? Is this an error, or did you have PR already but are unable to renew it?

Second, you can't get "implied status" unless you have a temporary resident permit of some sort (temporary work permit, visitors permit) which can be extended.

Third, you said you're waiting on an LMIA. Is it for PR only, or did your employer pay to support a work permit application as well?

The OP means "IEC" and is confused in thinking that IEC is the same as CEC.

So, unfortunately, if it's an IEC visa, it cannot be extended. Some IEC programs allow you to apply for a 2nd IEC visa if you are still eligible. Check that out.

If that is not an option, the best option is to wait for the LMIA to come through (hopefully your employer paid the fee to support the work permit application), then apply for the temporary work permit. Technically you won't have implied status; if the IEC expires, you won't be able to work until the until the TWP is approved.

If for some reason you're still waiting on the LMIA and you're within 2 weeks of the expiry of your IEC, you can apply for the TWP with the "LMIA pending." But you will also have to submit proof that your employer applied for the LMIA (e.g. copy of application, proof of mail/courier delivery, and perhaps you'll have an LMIA number by that time).
