Implied status in Canada while application is processed as outbound ?

My spouse is in Canada with me and we are preparing to send our sponsorship application shortly. Her status is a visitor and she is from a visa exempt country (France) and we are in Ottawa.

The application is going to be outbound (to try to speed up the processing). Her 6 month status will expire soon (based on the stamp in the passport). We had a child recently (born in Canada) and was wondering if this changes the situation in regards to the status, as she is the mother.

Can she remain in Canada once the application is sent? I've read some posts about 'implied status' and was wondering if this status is applicable to her based on the situation. Is there any exemption I can request to enable her to stay in Canada during the duration of the application processing given the baby situation?

Also, does the application automatically go to Mississauga (for evaluating me first) and then to France visa office based on her credentials?

Thanks in advance! :)

Your wife needs to extend her visitors visa.
Having a baby does not give her any rights to stay in Canada except as a visitor.
Implied status is for Inland applications only.
Yes the whole application is sent to Mississauga first. The first response will be from Mississauga with your sponsorship(SA).In this email they will inform you where the application is being sent .

Your wife will have implied status while she awaits the results of the visitor extension, and she will have to maintain legal status while remaining in Canada during the Outland Process. If her status is expiring soon you need to send in a visitor extension request right away.. It can take up to 3+ months to hear back from CIC about the extension if you send in a paper application verses a online application, either way your wife will be under implied status so all is well 8) I would ask for a year's extension so she can be here for most if not all the process.. You can also apply to extend again if needed by then .. Good luck! :)

You don't actually have to send it right away, you can send it on the last day and then your wife will have implied status for the duration of the wait for the extension.

Visitor extensions are almost always granted if you have a sponsorship application in process. You will have no issues. And as others stated, you need to apply for a visitor extension before it expires. Once you apply for a visitor visa extension, you have implied status.

Good luck!:)
