Impact of L1 Visa revocation on Canada PR

Hi All,

My spouse is the primary applicant and I am the co-applicant for the EE. We have received our ITA.
When in US, I was on L1 and my spouse was the dependent.

We went to the US on my L1 Visa in Apr 2014. I filed for an extension in Jul 2016 which was approved till Dec 2018. But in Sep 2017, the USCIS issued a revoke to my L1 alleging and owing to some discrepancies in the employer submitted documents. I became out of status and had to return to India. And since I became out of status, my spouse automatically became out of status too (collateral damage being an L2 Dependent)

While filling up the Post ITA application, under the Personal History -> Statutory Questions, there are two questions:
1) Has <<Name>> been refused refugee status, or an immigrant or permanent resident visa (including a Certificat de sélection du Québec (CSQ) or application to the Provincial nominee Program) or visitor or temporary resident visa, to Canada or any other country?

2) Has <<Name>> ever been refused a visa or permit, denied entry or ordered to leave Canada or any other country?

My questions below:
  • What is the difference in the above two questions?
  • What would be the answers to the above two questions - in case of applicant and the co-applicant?
  • If the answer is Yes for Co-applicant (as the revocation was notified to me), will this have an impact on our PR?
  • If the answer is Yes to both Applicant and Co-Applicant, will this have an impact on our PR?

The answer to question 1 with the explanation you have given would be no.

The answer to question 2 would be yes for both of you. You would also need to explain the circumstances under which it happened. Based on your explanation it should not affect you though. Just be totally honest in when completing the form.
