Hello,

I had my physical for immigration taken about 4 months ago. Unfortunately we still have some things to complete before we can submit our application. Which means we won't be submitting our application for about another month. That means my physical will be 5 to 6 months old by the time it is submitted. And my FBI background check will be about 4 months old. Will they still be accepted? Or am I going to have to pay another $500 for a new physical?

Medical results are valid for 1 year, so...you may get lucky.

FBI PCC is only valid for 90 days, so you will certainly need a new one.

Really?!?! The `ride' is going to be quite stressful and you're not even outta the starting gate yet! LOL!

Ok...If you are applying Inland, you can wait a few months before ordering another FBI PCC (and the fingerprints to go with that) if it makes you feel better. Just include a letter with your application stating that you had to request a second PCC and that you will forward that to CIC when it arrives. Heck, maybe you should send the expired PCC anyway, just so they know a) you had one and b) that you're `clean'. It can't hurt.

Now, if you're applying Outland, you can still send the letter and expired PCC, but it could cause your application to be returned, as it would be deemed `incomplete'.

CIC seems to understand that it takes time for the FBI PCC and while it is needed for both Inland and Outland applicants, it's not really needed by CIC for an Inland applicant until AIP (first stage approval) which is several months away.

The medical results are valid for 1 year AFTER CIC receives them, so it is possible that they will accept them. Do NOT rush out and get another examination. Wait until you hear from CIC!!!
 
Well we were going to do outland because it was supposed to be much faster. But I guess it wouldn't be if I am just going to have my application returned and have to start over.

Yes unfortuantely, the FBI background check can't be older than 3 months, so you will have to wait 6-8 weeks for a new one, by then your medical will be 6 months old. The medical will be fine, if they need you to do it again, they'll ask you, but the FBI check most certainly has to be done again.

Some people took a gamble and send the expired FBI check, and a letter saying they're getting a new one, but I don't think that has much success because your application might be deemed incomplete, and returned.
 
Your FBI PCC is the ONLY thing you would need to worry about having to redo at this point. That is $18 plus whatever the cost is to have your fingerprints taken wherever you have them taken.

Your medical exam is good for 12 months from the time you take it. It will be accepted up until that 12 month time marker is up. If your file takes longer than those 12 months it COULD be extended at the discretion of the CIC VO in charge of your application. You may or may not have to have this done again, however, it won't be for a long while yet, so don't stress over that yet.

Now, as Ponga said, if you are not dealing well with this before you even get your application mailed to CIC you are going to be in for one hell of a long stressful time ahead whether it is INLAND or OUTLAND. I suggest doing some Yoga or practicing your Zen Buddhist impersonation or maybe even seeing your family doctor for some Prozac or Xanax ;) This is a long and stressful process, however, it is worth it all in the end and you will be that much stronger for it.

Sit back, take a deep breath or three and then get your head together and put your application together as best as possible and hunker down for the wait.

Long story. Now what if we can get it submitted in the next week? but my FBI check will expire April 22? Is that too late? Would it not be worth the risk of being rejected and should I just get a new one?

Your FBI file will be acceptable up until the day it expires. Once your file is sent and accepted at CIC, then your date is 'locked' in. RARELY and I do mean ever so rarely that it almost is unheard of, you will be requested to get another clearance from the FBI, but as I said, it's a rarity so you should be fine if you can get it to CIC preferably at least a day or two before expiration.
 
April 22, that's plenty of time, 3 more weeks

You should spend these last 3 weeks getting your documents in order and complete.

The VO which deals with sponsor approvals has to receive the FBI check before April 22, after that, you're good as gold.

Relax take a deep breath, you've still got 3 weeks.
 
One more thing that is just as important...

Since it's taken you awhile to get your application together, make sure that CIC hasn't updated any of the forms that you are submitting, as they seem to do it fairly regularly. If you submit an outdated form, your entire application could be returned.

Well the reason why I said I may have to wait another month is that I was going to get a copy of my birth certificate to submit with my documents. But before I went to the notary to get the copy, I did a quick google search to confirm what I needed and I came across a website stating that I needed to order an original copy from the state which means a simple notarized copy wouldn't suffice. That process would take a month. Unless I were to send out my originals. I am from the United States if that matters. I made another thread here asking this question and it sounded like maybe I didn't need originals.
 
So then in this case, because it's an urgent matter, just send in your original birth certificate. you can always get another one later on. You don't need to submit notarized copies if you can send the original.

I answered your other thread as well, but so long as you have your original birth certificate and not the 'novelty' one with your footprints and such on it, you can just photocopy that and send it with your application. You don't need to send originals of your birth or marriage certificate or even your passport. Only a photocopy and that is sufficient.
 
For what it's worth, I submitted my outland application with an expired FBI background check. I included a letter explaining that if I were to wait for another FBI check to arrive (I live far from the US), my criminal records from my home country would have expired. I also included a photocopy of the new FBI form and fingerprint card that I had just sent again to the FBI.

After I got the new FBI background check, I sent it to the visa office along with a letter explaining the situation. That was a year ago. They did not reject my application and did not whine about the expired forms.
