my name is Don, i graduated college in Canada on 2009, i got a diploma degree in hotel and restaurant management , then i got a 2 years work permit ! after that, i apply for refugee under humanity , because of i am gay, the first hearing the judge rejected my case, then i appeal , and my lawyer was not really helpful , he totally misrepresented me. I got a letter from him, the letter was that my case has been dismissed my application of leaving on November 2012! i was thought that means i am okay , i don’t need to leave! but, the fact that means i fault my case i have to leave the country in 30 days, but i didn’t know about that until i get in touch with another lawyer, then i already become a deportation! so i leave canada on Jan 3 2013! i am really upset about this, if the lawyer told me earlier, i would leave on time, then i don’t need to apply for Authorization to Return to Canada.
My question are :
1: after deported from canada, Can i still apply under skilled worker or Canadian experience class immigrate back to canada?? coz i have 3 years working experience , and over 1 years management experience.
2: I have a work permit , it is valid until Aug 2014!! can i apply for TRV ,then ARC, or apply both in the same time! what is the chance i will get pass??
3: what is the best way that i can get back to canada??
The Border Service agent she told me that i DON’T need wait to apply back to canada! i can do it right away , she said no matter what vise i apply , i just need to do one more step it is apply one more thing that it is (ARC)!

Thank you so much !!

1. Yes - you can apply for the federal skilled worker program. Since you were deported, an ARC will have to be processed as part of your application.
2. You have almost zero chance of being approved for a TRV. I wouldn't bother applying. To be approved for a TRV, you must show you have strong ties to your home country and have no plans to remain in Canada long term. This will be impossible for you to prove given your failed refugee claim and very recent deportation. If you apply - expect a refusal.
3. If you qualify, should apply to immigrate through the FSW program, Canadian Experience Class or one of the provincial nominee programs.

No - you don't need to submit an ARC application. Just apply to immigrate and if you are accepted, CIC will automatically process the ARC application as well. Since you require an ARC, you should expect longer than normal processing times.
