Just wanted to confirm this form is only required when you do not have marriage certificate. Please advise/confirm.

I am working on to get temporary resident Visa for my In - Laws and they do not have marriage certificate?

The form is Statutory Declaration of Common-Law Union and not Statutory Declaration of Common in -Law, if your In-Laws are married they don't need this. The form is used for those in Common-Law Union but not married.
