IMM-5708 Form/ Extending visitor stay on eTA

Hi,

I arrived from a visa exempt country on eTA, I want to extend my stay while I look for work in Canada and I'm applying online.
Question number 3 on form IMM5708 says:
"" Check the appropriate box or boxes to indicate if you are applying for:

1- an extension of a temporary resident status
2- an initial or extension of a temporary resident permit
3- a restoration of your status as a visitor.
""

Should I mark 1 or 2? as I only have an eTA, is this an initial TRV? I'm confused
Should I state my intention of finding a job offer for immigration?

Hi,

A TRV is for someone who needs a visa to enter Canada. You are from a visa-exempt country i.e. you needed an eTA.

When you entered Canada, you were allowed to remain for 6 months i.e. you have visitor status currently.


To answer your questions:
1. You must apply for an extension to your temporary resident status (you are not applying for an initial TRV)

2. If your apply to extend your stay to look for work, it could result in a refusal

I'm still trying to resolve how to present the purpose of my extended stay, I'll give more details:
- I have a 8 years old child who is a Canadian citizen and lives with her mother in Canada.
- The mother has PR and has been living in Canada for 10 years. We separated 5 years ago.
- The mother and I have a written agreement of shared custody legalized in a court of law in BC. It states that while I am Canada I get to have my daughter over 50% of the time.
- Since I had to go back to my country when I lost status, I have only been able to visit 3 times the last five years prior this one, and never overstayed a visa.
- I intend to apply for skilled worker through PNP, but I do require a job offer for that. I already had a couple of interviews, am waiting for a reply, and applying for some other jobs, etc. I'm positive I'll find something.
- Besides funds to support my stay, also have a property in my name, that might help prove ties to my home country.
- I have an open return ticket on the airline valid til October.

With your response, I'm thinking of omitting my intention to find work and immigrate.

Hi,

With a Canadian citizen daughter + shared custody + your previous immigration history, etc, it will be a challenge to prove that you do not want to stay in Canada (and not just visiting). A PNP nomination would take time. The most important question: What is the reason to extend your stay?

Property in your home country may not be a compelling reason to return in the near future. Are you employed in your home country? Have you taken time off work? Will your daughter accompany you to your home country in the summer (if the courts have allowed this)?


When does your current status expire? You may also want to consider returning to your home country before your visitor status expires.... and then coming back to Canada after a few months
