**IF** Tourist visa extension gets denied - Can I still apply for PR inland?

Hi

----FACTS-----
1) My visitor visa STICKER issued by embassy said EXPIRY - DEC 17 (date i must enter canada by) - MULTIPLE ENTRY
2) The stamp that the BORDER AGENT STAMP put on the pass says EXPIRY - JAN 23 (the date i can stay till)
3) My wife is a canadian citizen, and we came here for some family issues, which are sorted now.
4) we wanna apply for PR

--THE ISSUE--
- Now, that our family issues are sorted, and as they were extremely stressful, both my wife and i would like to take a vacation (22 days) to S.America. The problem is that my visa (the sticker) expires on Dec 17, and we plan to leave on JAN 3 for the vacation and then want to back on JAN 25 to Canada

---QUESTION---
- So, do I have to apply for a VISITOR EXTENSION, which will allow me RE-ENTER canada?
- What if they DENY my visitor extension (i have funds, etc - but you never know)? Can I STILL apply for INLAND/OUTLAND PR while REMAINING in canada or do i have to leave the country?

Any help would be appreciated.

There is no such thing as a visitor extension which will allow a rentry. You need to apply for a new TRV.

Use the tool: http://www.cic.gc.ca/english/immigrate/eligibility.asp

If you are denied or not that has no effect on your ability to apply.

Yea, thats what I was afraid of. Can I apply for a new TRV from within Canada OR that option is only work/student permit holders ?

So, if my extension/TRV is denied, I can still apply for INLAND PR?

Yes. The only thing after that is that you cannot leave Canada for a long time, and you definitely could not go to live in your country of origin with your wife (she can, she is a Canadian citizen, but not you). Besides for you to get PR as a Family member your wife has demonstrate HER (and yours) intention TO ESTABLISH herself in Canada: to have a job, rent/buy a house and so on.

If your wife is a Canadian Citizen why can't you apply for PR. Except you don't want to be a pr.
