so the closer we get to the decision date, the more paranoid i am becoming about being approved as my husband's sponsor.. so i have a few questions that hopefully will put my mind at ease!

am i understanding correctly that there is no appeal process for the sponsor? if the sponsor is denied, that's final? but that the applicant can continue with his application? if i'm understanding that properly, my questions are these:

who else is eligible to sponsor my husband? he doesn't have family in Canada except me and my family (his in-laws). is a member of my family able to sponsor him? and if so, do we then move to the ridiculously long processing time of approval of a different class of sponsor?

or

can he apply on compassionate grounds? he is coming from Scotland, so he's certainly not a refugee.. does compassionate grounds apply to a married couple just wanting to be together? what is the likelihood of being granted PR based on compassionate grounds if i am denied as his sponsor? is the processing time the same for that type of application as for family class sponsorship?

thanks in advance!

You're the only one who can sponsor him. Your family cannot. If you are denied as a sponsor and have asked them to continue processing the application all the same - it will end in a refusal. Why are you concerned you'll be denied?

H&C is not a good route.

it's kind of embarrassing to say.. i meet all of the qualifications of a sponsor, so based on what is asked for, i am eligible. but my husband is my second husband, and my first husband was also from Scotland. i sponsored him to immigrate to Canada in 2007. i did not default on my contract, but we separated after a few years and he subsequently died, and i remarried. i am worried that CIC is going to refuse me based on the assumption that i am simply importing Scotsmen into Canada. :-[ has anyone else been denied for sponsoring a second spouse?

This isn't a reason to be denied at the sponsorship stage. If they were concerned about the relationship, the denial would come at the next stage once they are reviewing the applicant and the relationship itself. I highly doubt you have anything to worry about either way.

oh thank goodness... yes, i guess that makes sense - the issue i'm concerned about is more of a 'proving the relationship is genuine' kind than a 'could she ensure he won't be a drain on Canada's resources' kind. proving the relationship is genuine will be a piece of cake - our friends and family are grossed out with how in love with each other we are hahaha

thanks for easing my mind!!

Everyone's right, they won't deny you as a sponsor just because you sponsored a scot in the past, they go by the rules and it's not just arbitrary when it comes to sponsor approval. They are generally much less concerned about couples from 1st world countries for obvious reasons.

I met my American husband for the first time in a bar in Cardiff. I think that sort of counts too. :)

oh i am so glad to hear that, Taffy!!!! it's one thing to have others say they don't think there's reason for concern - it's another for someone in the same situation to confirm it :)

FWIW, spouse sponsorships are exempt from the "drain on Canada's resources" requirements present in other permanent residency processes.

I think spousal sponsorships are exempt from that only for medicals.

Though it says there is no minimum income to sponsor a spouse or dependent children, CIC does refuse spouses on grounds of "financial inadmissibility", if they are concerned they will end up on welfare. In such instances, they will ask the person being sponsored to demonstrate their ability to provide for their family, failing which the application may be denied. There is one member, "gango girl" who went through this but eventually won her appeal.

The undertaking signed by sponsor and sponsored person (IMM 1344), says the person being sponsored also agrees that they will do all they can be self-sufficient. I'll try to find the OP Manual that talks about this and will post it.
